About support of the separate state organizations of culture

For the purpose of creation of conditions for effective development national musical, choreographic, circus, theater, cinematography and ensuring cultural leisure of the population:

1. Determine that support at the expense of means is given:

1.1. republican or local budgets to the state organizations of culture on:

carrying out running repair of capital structures (buildings, constructions), the isolated rooms, their parts;

acquisition of the equipment and other fixed assets, and also on carrying out capital repairs, reconstruction of capital structures (buildings, constructions), the isolated rooms, their parts included in the corresponding cost budget;

1.2. the republican budget to the state organizations of cinematography performing production of movies on acquisition of the equipment, other fixed assets;

1.3. republican or local budgets in the form of provision of subsidies:

to the state organizations of culture (except for theaters) on financing of the current expenses connected with cultural activities according to standard rates of ensuring cultural activities;

to theaters on financing of the expenses connected with implementation of the current activities, not specified in subitem 1.1 of this Item according to the standard rate of ensuring the current activities of theaters in the amount of actually gained income of theaters. The sizes of subsidy cannot be less than the size (taking into account actually gained income of theaters) providing to workers minimum wage (including fees on the national social insurance) taking into account guarantees, stipulated by the legislation about work;

to the state theatrical and spectacular organizations (except for theaters) on creation and updating of concert programs, circus representations and holding tours;

to the state organizations of cinematography performing display and (or) distribution of movies on acquisition of copies of movies and the rights to use movies.

Types of standard rates of ensuring cultural activities of the state organizations of culture (except for theaters) and procedure for their determination, the standard rate of ensuring the current activities of theaters and procedure for provision to theaters of subsidies for financing of the expenses specified in paragraph three of part one of this subitem are established by Council of Ministers of the Republic of Belarus;

1.4. republican or local budgets to theaters in case of temporary release of own scenic platform of theater during on it capital repairs, reconstruction, repair and restoration works on financing:

expenses on payment of utilities on content of own scenic platform;

expenses on hiring of the transport used for implementation of cultural activities at suppliers whose selling price on service in case of its realization to theater is created proceeding from the size of economically reasonable costs and the limiting standard rate of profitability used for determination of the amount of the profit which is subject to inclusion in selling prices, no more than 10 percent;

expenses to loaner and (or) the lessor on content, operation, utility payments, running repair of the transferred to free use and (or) leasable property in the amount of 50 percent if obligations on content, operation, utility payments, running repair are assigned under the contract of free use and (or) lease for loaner and (or) the lessor.

2. Grant the right to the state organizations of culture to perform at the expense of the money received from sales of products, goods (works, services), the stimulating payments to employees of these organizations on condition of availability of net profit in the amount at least 10 percent from settlement size. These payments are performed by theaters after providing in full the expenses connected with their activities.

Funds in the amount of net profit are allocated by the state organizations of culture for acquisition of fixed assets, their reconstruction, restoration, carrying out other similar works.

3. Legal entities and physical persons, including individual entrepreneurs, members of the board of trustees of the state organizations of culture have the right to give free (sponsor's) aid (to do donations) on payment of remunerations to physical persons from number of persons employed of the state organizations of culture. These remunerations are paid according to the procedure, determined by the Ministry of Culture.

3-1. Determine that for carrying out capital repairs, reconstruction, repair and restoration works on own scenic platform of theater capital structures (buildings, constructions), the isolated rooms, parking places, their parts which are in state-owned property are transferred to theaters to free use for implementation of cultural activities.

4. For the purposes of this Decree terms in the values determined in appendix 1 are used.

5. Recognize invalid presidential decrees of the Republic of Belarus (appendix 2).

6. To Council of Ministers of the Republic of Belarus:

6.1. till January 1, 2024:

establish the standard rate of ensuring the current activities of theaters and procedure for provision to theaters of subsidies;

provide reduction of acts of the legislation in compliance with this Decree and take other measures for its realization;

6.2. annually when forming the republican budget for the next financial year to provide funds for the purposes determined in Item 1 of this Decree.

7. To local executive and administrative organs annually when forming local budgets for the next financial year to provide funds for the purposes determined in subitems 1. 1, 1.3 and 1.4 Items 1 of this Decree.

8. To impose control over the implementation of this Decree on the State Control Committee.

9. This Decree becomes effective in the following procedure:

Items 1-5 - since January 1, 2024;

other provisions of this Decree - after its official publication.

List of terms and their determinations

1. The state organizations of culture - the state theatrical and spectacular organizations, the state recreation parks, zoos, the state organizations of cinematography performing display and (or) distribution of movies, and also the state organizations of culture of the mixed type regarding their structural divisions performing cultural activities by means of ensuring creation of execution of works of theatrics and their public performance.

2. Theaters - the state theaters and the state organizations of culture of the mixed type regarding their structural divisions performing cultural activities by means of ensuring creation of execution of works of theatrics and their public performance.
