About some questions of application of navigation seals

According to the subitem 3 of Item 2 of Article 3 and the paragraph the second Item 1 of article 8 of the Agreement on application in the Eurasian Economic Union of navigation seals for tracking of transportations of April 19, 2022 and Items 46 and 47 of appendix No. 2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Board of the Eurasian economic commission solved:

1. Approve enclosed:

Procedure for making of transactions on imposing (removal) of navigation seals on customs area of the Eurasian Economic Union;

Transmission order, document storage (data) and destruction (erasing) of information written earlier for tracking of specific transportation.

2. Determine that:

a) persons responsible for providing subject to tracking with necessary quantity of navigation seals, customers (consumers) of services in tracking of transportation using navigation seals (the sender, the freight forwarder, carrier, the receiver) are;

b) places of imposing (removal) of navigation seals on customs area of the Eurasian Economic Union are:

in case of customs procedure of customs transit - customs control zones;

in case of customs procedure of export - customs control zones, the territories of the sender or other places if such places are determined by the legislation of state members of the Eurasian Economic Union (further - state members);

when moving between state members within mutual trade:

for the goods specified in the subitem 3 of Item 1 of article 3 of the Agreement on application in the Eurasian Economic Union of navigation seals for tracking of transportations of April 19, 2022:

the place of imposing - the territory of the sender or other places if such places are determined by the legislation of state members;

the place of removal - the receiver's territory;

for goods to which special economic measures are applied:

the place of imposing - the territory of the sender or other places if such places are determined by the legislation of state members;

the place of removal - the place of departure from the territory of state member of goods to which such measures, or the receiver's territory are applied in case of arrival of the specified goods in the destination;

c) persons imposing (removing) navigation seals when placing goods under customs procedure of customs transit and customs procedure of export, and also when moving goods between state members within mutual trade are:

national operator;

other persons, if such persons are determined by the legislation of state members;

d) persons which are present when imposing (removal) of navigation seals are:

when placing goods under customs procedure of customs transit or customs procedure of export:

in case of motor transportations - carrier, the official of customs authority (in case of adoption of such decision by it);

in case of rail haulings:

carrier - in case of implementation of transactions on imposing (removal) of navigation seals in the places of imposing (removal) determined by this Decision which are directly on the ways of the railway station;

the sender or the customs applicant - in case of implementation of transactions on imposing of navigation seals in the places of imposing determined by this Decision which are not on the ways of the railway station;

the receiver or the owner of the customs control zone - in case of implementation of transactions on removal of navigation seals in the places of removal determined by this Decision which are not on the ways of the railway station;

the official of customs authority - in case of adoption of such decision by it;

when moving goods between state members within mutual trade:

in case of motor transportations - carrier, the official of monitoring body (in case of adoption of such decision by it);

in case of rail haulings:

carrier - in case of implementation of transactions on imposing (removal) of navigation seals in the places of imposing (removal) determined by this Decision which are directly on the ways of the railway station;

the sender - in case of implementation of transactions on imposing of navigation seals in the places of imposing determined by this Decision which are not on the ways of the railway station;

the receiver - in case of implementation of transactions on removal of navigation seals in the places of removal determined by this Decision which are not on the ways of the railway station;

the official of monitoring body - in case of adoption of such decision by it;

e) the persons which are imposing (removing) navigation seals and present at such imposing (removal), at removal of navigation seals along the line (transportation) without the termination of observation of subject to tracking or replacement of navigation seal along the line (transportation) of subject to tracking and their subsequent imposing are:

the official of customs or other monitoring body of state member in the territory of which there was need of removal (replacement) of navigation seal;

the national operator or carrier - with the permission of the official of customs or other monitoring body of state member in the territory of which there was need of removal (replacement) of navigation seal.

3. This Decision becomes effective after 30 calendar days from the date of its official publication.

Procedure for making of transactions on imposing (removal) of navigation seals on customs area of the Eurasian Economic Union

1. This Procedure determines transactions by imposing (removal) of the navigation seals applied according to the Agreement on application in the Eurasian Economic Union of navigation seals to tracking of transportations of April 19, 2022 (further - the Agreement) on customs area of the Eurasian Economic Union (further - the Union), and procedure for their making.

2. The concepts used in this Procedure are applied in the values determined by the Agreement.

3. When imposing navigation seal the national operator in whose information system the navigation seal is registered confirms possibility of its use for tracking of transportation of subjects to tracking on the territories of state members of the Union (further - state members), including condition of level of charge of the power supply (accumulator) of navigation seal at the level of not lower than 75 percent.

Imposing of navigation seal concerning which the possibility of its use for transportation tracking is not confirmed is not allowed.
