About measures for the effective organization of public administration in the sphere of construction and housing and communal services within administrative reforms

For the purpose of ensuring execution of the Presidential decree of the Republic of Uzbekistan of January 25, 2023 No. UP-14 "About First-priority Organizational Measures for Effective Establishing Activities of Republican Executive Bodies", and also the effective organization of public administration in the sphere of construction and housing and communal services:

1. Approve:

Priority activities of the Ministry of Construction and Housing and Communal Services according to appendix No. 1;

The program of reorganization of organizations in system of the Ministry of Construction and Housing and Communal Services according to appendix No. 2;

The program of the organization of activities of the new establishments created in the sphere of construction and housing and communal services according to appendix No. 3;

Organizational structure of the Ministry of Construction and Housing and Communal Services according to appendix No. 4;

"Road map" on deepening of reforms in the sphere of construction and housing and communal services and transformation of activities of system according to appendix No. 5.

2. Transfer Head department of housing-and-municipal servicing of the city of Tashkent and district departments from subordination of khokimiyat of the city of Tashkent in subordination of the Ministry of Construction and Housing and Communal Services (further - the Ministry) and to transform to Head department of housing and communal services of the city of Tashkent and district departments.

3. For the purpose of strengthening of the control system in the sphere of construction and housing and communal services and expansion of its scope:

keep the operating sources of financing of activities of Inspectorate for control in the sphere of construction and housing and communal services (further - Inspection) and territorial inspections, and also to list the penalties for violation of requirements of the legislation on town planning levied by them from perpetrators within the powers in the amount of 60 percent - into the off-budget account of Inspectorate and 20 percent in Fund of support of activities of the Ministry of Construction and Housing and Communal Services;

establish the number of employees of territorial inspectorates it is proportional to quantity, amount and remoteness of the objects accepted on control;

to perform obligatory control actions of subjects of construction activities (concerning customers, designers, contractors) on the electronic platform "The State Control in Construction" of the National information system "Transparent Construction";

determine that the Inspectorate bears responsibility for implementation of the state control of quality and compliance of installation and construction works on construction objects of the project documentation, operation of apartment dwelling stock and use of drinking water;

determine that the Ministry of Construction and Housing and Communal Services bears responsibility for implementation of the state architectural control of observance by subjects of town-planning activities of town-planning documentation of settlements.

4. Determine that the organization of activities, control and the common directorship by territorial inspectorates are performed by Inspectorate and the Cabinet of Ministers on the basis of system of vertical management.

At the same time to public authorities on places and to other relevant organizations (departments) it is strictly forbidden to interfere or make impact on legal activities of territorial inspections.

5. Implement system of certification once in three years on activities of the following professional categories in the sphere of town planning:

a) since October 1, 2023:

the specialists exercising project management and engineering supervision, including control in the directions;

the specialists exercising author's control and also chief engineers and the chief architects of projects of the project organizations;

the specialists exercising internal control in contract organizations;

b) since January 1, 2024:

the specialists performing control measurements;

experts of the expert organizations;

heads of governing bodies of apartment houses;

c) since April 1, 2024:

architects of areas (cities) and areas;

inspectors of territorial inspectorates for control in the sphere of construction and housing and communal services.

At the same time function of working body for the organization of works on certification of specialists is assigned to the Institute on development of competences formed under the Ministry.

6. Make changes and additions to some acts of the President of the Republic of Uzbekistan according to appendix No. 6.

7. Recognize invalid some acts of the President of the Republic of Uzbekistan according to appendix No. 7.

8. To the Ministry of Construction and Housing and Communal Services together with the Ministry of Justice, other interested ministries and departments in two-month time to make in the Cabinet of Ministers offers on the changes and amendments in acts of the legislation following from this Decree.

9. Assign to the Minister of Construction and Housing and Communal Services B. I. Zakirov the personal responsibility for the effective organization of execution of this Decree.

To assign discussion of course of execution of this Decree, implementation of coordination and control of activities of the responsible organizations to the Prime Minister of the Republic of Uzbekistan A. N. Aripov.

 

Appendix No. 1

Priority activities of the Ministry of Construction and Housing and Communal Services

Priority activities of the Ministry of Construction and Housing and Communal Services are:

a) the organization of timely, high-quality development and approval of regulating documents in the field of technical regulation, and also town-planning regulations and rules;

b) organization of development and ensuring control of observance of town-planning documentation of settlements, and also maintaining the town-planning inventory;

c) the organization of development of the individual, standard, repeatedly applied pilot projects and energy saving project decisions, and also coordination and licensing of activities of project and contract organizations, ensuring conducting examination of town-planning documentation;

d) implementation of transparent system of cost determination of goods and services in the construction market and the organization of public procurements;

e) strengthening of requirements of seismic safety during the designing and construction of buildings and constructions;

e) coordination of operational activities, ensuring control, cardinal reforming of systems of drinking water supply, sewerage and heat supply, and also digitalization of the sphere;

g) enhancement and organization of effective activities of management system by apartment houses, ensuring control of operation of apartment dwelling stock, and also coordination of works on carrying out renovation of emergency and obsolete houses;

h) preparation, retraining, advanced training in local and foreign lead educational institutions, the organization of assessment work of competences and coordination of certification processes of personnel in the sphere of construction and housing and communal services.

Public institution "Center of development of information and communication technologies in sphere of construction"	The republican center of development of information and communication technologies under the Ministry of Construction and Housing and Communal Services in the form of public institution	The structure and established posts of the center affirm the Ministry proceeding from the directions it activities and amount of works. The center performs financial and economic activities by means of bank accounts as it is the self-financed organization (implementation of activities on the basis of cost accounting). Works (service) of central office of the Ministry connected with information and communication technologies are carried out by the Center gratuitously and in necessary cases in its order material and technical resources and other means of the Ministry are donated, and also material logistics and procurements with respect thereto are conducted by the Center through own means.
