According to parts one and the fifth Article 187 of the Code of penal procedure of the Republic of Kazakhstan, Item 3 of article 9 of the Law of the Republic of Kazakhstan "About counteraction to terrorism" and subitem 313-2) of Item 15 of the Regulations on Committee of homeland security of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of April 1, 1996 No. 2922, I ORDER:

1. Approve the enclosed Rules of establishment and payment of remuneration for information which helped to prevent or stop the act of terrorism.

2. To provide to the headquarters of the Anti-terrorist center of Committee of homeland security of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of Committee of homeland security of the Republic of Kazakhstan.

3. To inform employees and military personnel of bodies of homeland security of the Republic of Kazakhstan of this order.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of establishment and payment of remuneration for information which helped to prevent or stop the act of terrorism

Chapter 1. General provisions

1. These rules of establishment and payment of remuneration for information which helped to prevent or stop the act of terrorism (further - Rules) are developed according to parts one and the fifth Article 187 of the Code of penal procedure of the Republic of Kazakhstan, Item 3 of article 9 of the Law of the Republic of Kazakhstan "About counteraction to terrorism" and subitem 313-2) of Item 15 of the Regulations on Committee of homeland security of the Republic of Kazakhstan approved by the Presidential decree of the Republic of Kazakhstan of April 1, 1996 No. 2922 and determine procedure for establishment and payment of remuneration for information which helped to prevent or stop the act of terrorism.

2. In these rules the following basic concepts are used:

1) financial division of bodies of homeland security of the Republic of Kazakhstan - structural division of Committee of homeland security of the Republic of Kazakhstan (further - KNB) or division of territorial authority of KNB to which functions on carrying out payments and implementation of money transfers are assigned;

2) authorized division - the structural division of KNB or division of territorial authority of KNB authorized on conducting operational search and counterintelligence activities.

3. To persons who reported information which helped to prevent or stop the act of terrorism (further in bodies of homeland security or internal affairs of the Republic of Kazakhstan - person who gave information), KNB or its territorial authorities pay remuneration for the account of the budgetary funds provided by KNB for the corresponding financial year on these purposes.

Chapter 2. Procedure for establishment of remuneration for information which helped to prevent or stop the act of terrorism

4. Remuneration is established in the following procedure:

1) on the criminal cases about the act of terrorism provided by parts one and the second article 255 of the Criminal Code of Kazakhstan (further - UK), - 750 (seven hundred fifty) monthly settlement indicators (further - MRP);

2) on the criminal cases about the act of terrorism provided by parts three and the fourth article 255 UK - 1000 (one thousand) MRP.

5. Remuneration is paid to person who gave information if concerning the perpetrator:

1) the conviction or the court order about application of enforcement power of medical nature according to Article 521 of the Code of penal procedure of the Republic of Kazakhstan took legal effect (further - the Code of Criminal Procedure);

2) the decree on the termination of criminal case on the bases provided by subitems 9), 11) and 12) of part one of article 35 Code of Criminal Procedure is issued.

6. Investigative divisions of bodies of homeland security of the Republic of Kazakhstan within 3 (three) working days from the moment of approach of circumstances, stipulated in Item 5 these rules, send the coupon notification to the person who gave information about emergence of the right to remuneration.

If criminal proceeding is performed by law-enforcement bodies of the Republic of Kazakhstan, the direction of the coupon notification is performed by investigative divisions of law-enforcement bodies of the Republic of Kazakhstan.

The authorized division is also notified on the right to remuneration by person who gave information.

7. For receipt of remuneration person who gave information provides in bodies of homeland security or internal affairs of the Republic of Kazakhstan the documents specified in subitems 1), 4) and 5) of Item 8 of these rules within 3 (three) months from the date of delivery of the coupon notification.

In case of refusal from remuneration, person who gave information submits the corresponding statement to bodies of homeland security or internal affairs of the Republic of Kazakhstan.

8. The authorized division or law-enforcement bodies of the Republic of Kazakhstan create the following documents:

1) the statement of person who gave information for remuneration payment;

2) copy of root of the coupon notification;
