About measures for project implementation "Development and upgrade of water supply systems and the sewerage of the Bukhara region (the 2nd stage)" with participation of the Asian Infrastructure Investment Bank

For the purpose of increase in level of providing services for drinking water supply and sewage of the population and subjects of entrepreneurship of the Bukhara region, further improvement of sanitary and epidemiologic and ecological situation in area, and also cooperation increase with the Asian Infrastructure Investment Bank:

1. Take into consideration that:

The Asian Infrastructure Investment Bank (further - ABII) within project implementation "Development and upgrade of water supply systems and the sewerage of the Bukhara region (the 2nd stage)" (further - the project) in the Republic of Uzbekistan:

a) allocation of loan in the amount of 248, of 40 million US dollars with return condition within 25 years, including five-year grace period is approved;

b) the total cost of the project constitutes 281, 25 million US dollars, including:

contribution of the Republic of Uzbekistan to project implementation in the form of covering of the value added tax and provision of customs privileges - 32, 85 million US dollars;

2. Determine that:

a) JSC Uzsuvtajminot is the executive body responsible for ensuring timely holding the organizational and technical actions necessary for high-quality project implementation, and also target and effective use of loan of ABII;

b) khokimiyat of the Bukhara region together with JSC Uzsuvtajminot bear responsibility for high-quality project implementation, achievement of the established indicators and timely loan repayment of ABII.

3. Approve:

The key technical and economic parameters of the feasibility statement on the "Development and Upgrade of Water Supply Systems and Sewerage of the Bukhara Region (2nd Stage)" project according to appendix No. 1;

The forecast repayment schedule of principal debt of ABII, payment of the commission for obligations and the one-time commission on the "Development and Upgrade of Water Supply Systems and Sewerage of the Bukhara Region (2nd Stage)" project according to appendix No. 2;

The forecast of distribution of shares for covering of maintenance expenses of borrowed funds of ABII within the "Development and Upgrade of Water Supply Systems and Sewerage of the Bukhara Region (2nd Stage)" project according to appendix No. 3;

"Road map" on financial improvement of Bukhoro suv tajminoti LLC according to appendix No. 4.

4. Approve the offer of khokimiyat of the Bukhara region, JSC Uzsuvtajminot, Prosecutor General's Office and Ministry of investments, the industry and trade on implementation of new construction projects of only 1 157,2 km of networks of drinking water supply and 117,3 of km of networks of sewage, in particular, of networks of drinking water supply in Dzhandarsky district - km 409,3, Peshkunsky district - 305,9 of km and Romitansky district - 442 km, networks of sewage in the city of Bukhara - km 117,3 on not covered the project the territories of the Bukhara region according to appendix No. 5 at the expense of the means saved within the project.

5. Authorize the Minister of Economy and Finance of the Republic of Uzbekistan:

sign the loan agreement on project implementation with ABII on behalf of the Republic of Uzbekistan, if necessary - to make changes and additions to this agreement;

sign the agreement on loaning up of borrowed funds of ABII with khokimiyat of the Bukhara region, JSC Uzsuvtajminot and Bukhoro suv tajminoti LLC on behalf of the Republic of Uzbekistan, if necessary - to make changes and additions to this agreement.

6. Issue to the Ministry of Justice in accordance with the established procedure the legal conclusion under the loan agreement between the Republic of Uzbekistan and ABII, the agreement on loaning up, if necessary - on modification and amendments in the specified agreements.

7. Take into consideration that the goods acquired by legal entities within the projects realized at the expense of means (loans, the credits) of the international financial institutions and foreign government financial institutions according to international treaties of the Republic of Uzbekistan are exempted from customs duty.

Determine that within project implementation:

the formed tax amount on value added is paid at the expense of means of business entities or compensated at the expense of means of the republican budget according to the procedure, established by the legislation;

release of imported goods from customs duty and tax amount covering on value added at the expense of means of the republican budget is contribution of the Republic of Uzbekistan to project implementation.

8. Assign to the acting as the chairman of the board of JSC Uzsuvtajminot D. Azimov of function on:

to ensuring timely accumulation from Bukhoro suv tajminoti LLC of the means necessary for loan repayment of ABII and interest payment, in accordance with the terms of the agreement on loaning up;

to coordination and project management with additional involvement of qualified specialists in Group of coordination of the ABII projects as a part of JSC Uzsuvtajminot recommended by khokimiyat of the Bukhara region;

to approval of the Ministry of Economics and finance of annual expense budget on financing of activities and the staff list of Group of coordination of the ABII projects during project implementation.
