About export licensing of the raw skins of cattle

Based on articles 29 and 47 of the Agreement on the Eurasian Economic Union of May 29, 2014 and subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 124

1. Determine that under the one-time licenses granted by the Ministry of anti-monopoly regulation and trade (further - MARCH) in coordination with the Belarusian state concern on production and sales of goods of light industry (further - Bellegprom concern) according to the procedure, similar the established Rules of issue of licenses and import permits and (or) commodity import provided by appendix to the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014), taking into account the features established by this resolution perform export:

out of limits of the Republic of Belarus in state members of the Eurasian Economic Union (further - EEU) the raw skins of cattle * (code of 4101 single Commodity nomenclatures of foreign economic activity of EEU) (further - rawhide), occurring from the territory of the Republic of Belarus;

out of limits of customs area of EEU in the Republic of Belarus to the states which are not state members of EEU, the rawhide occurring from the territory of the Republic of Belarus in case of its room under customs procedure of export.

2. The interested person (his representative) for receipt of approval of licensing for rawhide export (further - the license) addresses to Bellegprom concern with submission of the following documents:

the letter in any form to approve licensing with indication of the producer with reasonable request, the offered amount of export delivery, availability of the rawhide amount offered to realization in warehouses of the interested person, the country of its appointment, delivery conditions and payments;

the application for licensing (in duplicate) issued according to the Instruction about execution of the statement on licensing for export and (or) import of separate types of goods and about execution of such license approved by the Decision of Board of the Eurasian economic commission of November 6, 2014 No. 199 (further - the statement);

the document certifying the right to representation of interests of the interested person;

the copy of the contract in foreign trade (contract) for supply of rawhide signed by results of the exchange biddings for export, including appendices to it, specifications (in case of their availability);

at the price, in terms and on payment terms it is not worse than the copy of letters of the organizations processing rawhide about refusal of its acquisition in quantity, than it is provided by the called contract in foreign trade.

In addition to the documents specified in part one of this Item, documents can be requested by Bellegprom concern:

proving the citizen's identity;

confirming official position of the head of the legal entity, and also proving his identity;

confirming state registration of the legal entity or individual entrepreneur.

The documents specified in this Item are represented to Bellegprom concern during acceptance of the interested person (his representative), by mail or the courier (courier).

3. Copies of documents for review the licensing which arrived in Bellegprom concern in two-day time go it to the Ministry of Agriculture and Food (further - Ministry of Agriculture and Food Production) for review supply of rawhide to export.

4. Ministry of Agriculture and Food Production performs approval of supply of rawhide for export or refuses its approval within three working days from receipt date of copies of the documents specified in Item 2 of this resolution by the direction of the corresponding letter.

The bases for refusal in approval of supply of rawhide for export are:

failure to carry out by the interested person of obligations on supply of rawhide on account of republican state needs since the beginning of calendar year (the accruing result);

absence at the self-produced interested person of rawhide;

absence at the interested person in warehouses of the rawhide amount declared to realization.

5. The Bellegprom concern within five working days considers the documents which arrived from the interested person and in the presence of the letter of Ministry of Agriculture and Food Production specified in part one of item 4 of this resolution makes the decision on approval of licensing or on refusal in approval of its issue.

The bases for refusal in approval of licensing are:

failure to carry out by the interested person of the delivery schedule of rawhide on account of republican state needs since the beginning of calendar year (the accruing result);

lack of approval of supply of rawhide for export by Ministry of Agriculture and Food Production;

liquidation (activities termination), death of the interested person;

provision by the interested person (his representative) of the documents and (or) data which are not conforming to requirements of the legislation, including false, forgery or invalid documents.

6. Approval of licensing is performed by Bellegprom concern on a grant basis by putting down on the statement of the signature of person authorized on approval and impress of a seal of Bellegprom concern.

Licensing approval effective period - before date of issue of the license.

7. The approved statement goes Bellegprom concern to the interested person by mail or is handed personally under list.

8. The Bellegprom concern in coordination with Ministry of Agriculture and Food Production has the right to address in MARCH with reasonable offers on suspension or cancellation of licenses.

9. MARCH:

makes decisions on suspension or cancellation of licenses in the cases specified in Rules of issue of licenses and import permits and (or) commodity import, provided by appendix to the Protocol on measures of non-tariff regulation concerning the third countries (appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014), and also in case of receipt from Bellegprom concern of relevant proposals;
