About procedure for the organization and conducting state examination of the project documentation and results of engineering researches

In pursuance of parts 3(11) and 11 of article 49 of the Town-planning code of the Russian Federation the Government of the Russian Federation decides:

1. Approve the enclosed Regulations on the organization and conducting state examination of the project documentation and results of engineering researches.

2. Determine that:

a) Items 46 - 48 Provisions, approved by this resolution, are subject to application since January 1, 2009;

b) state examination of the project documentation of capital construction projects and results of the engineering researches which are carried out for such objects will be organized and carried out:

concerning the objects specified in Item 5.1 of part 1 of article 6 of the Town-planning code of the Russian Federation, objects the construction, reconstruction, major repair, demolition, works on preserving objects of cultural heritage (historical and cultural monuments) the people of which Russian Federation is financed with attraction of financial resources of the federal budget (except for objects, the specified in paragraphs three - the fifth and seventh this subitem), and also objects, construction which reconstruction is supposed to be performed on lands of especially protected natural territories of federal importance, - state (budget or autonomous) the organization subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation;

concerning the objects specified in Item 5 (1) parts 1 of article 6 of the Town-planning code of the Russian Federation, the Armed Forces of the Russian Federation which are military facilities, the Ministry of Defence of the Russian Federation, concerning other subjects to defense and safety which are under authority of federal executive bodies - the federal executive bodies authorized on conducting state examination of the project documentation and results of engineering researches by presidential decrees of the Russian Federation;

concerning infrastructure facilities of extra street transport and unique objects, construction which reconstruction is supposed to be performed in the territory of Moscow, - executive body of Moscow or subordinated to it state (budget or autonomous) organization;

concerning capital construction projects of the federal nuclear organizations - State Atomic Energy Corporation "Rosatom";

concerning the objects specified in Items 1 - 5 parts 3(4) of article 49 of the Town-planning code of the Russian Federation (except for the objects specified in paragraphs the second - the fifth and eighth this subitem), and also concerning other objects if conducting examination (state or non-state) is obligatory or if conducting examination (state or non-state) concerning the project documentation and (or) results of engineering researches is not obligatory according to parts 2, 3 and 3 (1) article 49 of the Town-planning code of the Russian Federation and the applicant the decision on the direction of the project documentation and (or) results of engineering researches for state examination is made, - authorized on conducting state examination of the project documentation and results of engineering researches by executive bodies of subjects of the Russian Federation or subordinated to these bodies state (budget or autonomous) organizations in the location of the parcel of land on which it is supposed to perform construction, reconstruction, major repair, asset demolition of capital construction, work on preserving objects of cultural heritage (historical and cultural monuments) the people of the Russian Federation;

concerning capital construction projects of state-owned property of subjects of the Russian Federation or municipal property (except the objects specified in Item 5.1 of part 1 of article 6 of the Town-planning code of the Russian Federation) - authorized on conducting state examination of the project documentation and results of engineering researches by executive bodies of subjects of the Russian Federation or subordinated to these bodies state (budget or autonomous) organizations in the location of the parcel of land on which it is supposed to perform construction, reconstruction, major repair, asset demolition of capital construction, work on preserving objects of cultural heritage (historical and cultural monuments) the people of the Russian Federation, or state (budget or autonomous) organization, subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation (at the choice of the applicant);

concerning objects, the construction, reconstruction, major repair, demolition, works on preserving objects of cultural heritage (historical and cultural monuments) the people of which Russian Federation is provided with attraction of financial resources of the legal entities created by the Russian Federation, subjects of the Russian Federation, municipalities or legal entities, share of the Russian Federation, subjects of the Russian Federation which municipalities in the authorized (share) capital constitutes more than 50 percent (except for the objects specified in paragraphs the second - the fifth and seventh this subitem), - authorized on conducting state examination of the project documentation and results of engineering researches by executive bodies of subjects of the Russian Federation or subordinated to these bodies state (budget or autonomous), organizations in the location of the parcel of land, on which it is supposed to perform construction, reconstruction, major repair, asset demolition of capital construction, work on preserving objects of cultural heritage (historical and cultural monuments) the people of the Russian Federation, or state (budget or autonomous) the organization subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation (at the choice of the applicant);

concerning objects, construction which reconstruction is supposed to be performed in the territories of two and more subjects of the Russian Federation (except for the objects specified in paragraphs the second - the fifth and eighth this subitem) - authorized on conducting state examination of the project documentation and results of engineering researches by executive bodies of subjects of the Russian Federation (from among subjects of the Russian Federation in which territories it is supposed to perform construction reconstruction of the objects specified in this paragraph) or subordinated to these bodies state (budget or autonomous) organizations in the location of one of the parcels of land on which it is supposed to perform construction, reconstruction of capital construction project (at the choice of the applicant);

concerning the objects located in the territories of two and more subjects of the Russian Federation which reconstruction is supposed to be performed in the territory of one subject of the Russian Federation (except for the objects specified in paragraphs the second - the fifth and eighth this subitem) - authorized on conducting state examination of the project documentation and results of engineering researches by executive bodies of subjects of the Russian Federation or subordinated to these bodies state (budget or autonomous) organizations in the location of the parcel of land on which it is supposed to perform reconstruction of capital construction project;

(1)) state examination of the project documentation and results of engineering researches concerning the objects which are not specified in the subitem "b" of this Item, and objects, conducting state examination concerning which is not referred by the Federal Laws, presidential decrees of the Russian Federation or regulatory legal acts of the Government of the Russian Federation to powers of other federal executive bodies and the organizations, is carried out by representatives on conducting state examination by executive bodies of subjects of the Russian Federation or subordinated it state (budget or autonomous) organizations in the location of the parcel of land on which it is planned to perform construction, reconstruction, major repair of capital construction project;

c) when conducting state examination of the project documentation and results of engineering researches assessment of the project documentation and results of engineering researches on conformance to requirements, the been subject of sanitary and epidemiologic examination, state ecological assessment, state historical and cultural examination, state examination of work environment, state examination in the field of protection of the population and the territories against emergency situations and examination of industrial safety, is not carried out if before entry into force of the Provision approved by this resolution by results of the specified examinations the positive decisions are received and also if the positive decisions by results of the specified examinations are received on materials, directed for conducting these examinations till January 1, 2007. Conclusions of these examinations are considered by preparation of the conclusions of state examination of the project documentation and results of engineering researches;

d) the state examinations of the project documentation and results of engineering researches begun before entry into force of the Provision approved by this resolution are subject to completion by bodies (public institutions) which began them. Repeated state examinations of the project documentation and results of engineering researches can be carried out till January 1, 2008 by bodies (public institutions) which issued the negative conclusions by results of primary state examinations;

e) the summary conclusion of state examination of the project documentation issued before entry into force of the Provision approved by this resolution, and containing conclusions about the recommendation of the project documentation to approval is equated to the positive conclusion of state examination of the project documentation and results of engineering researches. The specified summary conclusion, and also the positive conclusion of state examination of the project documentation issued according to the Provision approved by this resolution, before entry into force of the acts of the Government of the Russian Federation provided by the subitem "an" of Item 3 and item 4 of this resolution, and containing positive assessment of the estimated cost which is carried out in the cases specified in the subitem "i" of this Item concerning capital construction project, construction or reconstruction of which is financed fully or partially by means of the federal budget, are equated to the positive conclusions about efficiency, about reliability and about assessment of justification of use of the funds of the federal budget allocated for capital investments;

e) before approval of requirements to structure, content and procedure for execution of the conclusion of state examination of the project documentation and results of engineering researches the specified conclusions are drawn up in any form;

g) the project documentation which development is begun before entry into force of the Regulations on structure of Sections of the project documentation and requirements to their content approved by the Government of the Russian Federation when conducting state examination is checked for compliance to structure and the requirements to contents of Sections of this documentation established by normative technical requirements on its development;

h) till January 1, 2008 the conclusion of state examination of the project documentation and results of engineering researches is signed by persons participating in conducting this state examination;

i) before entry into force of the act of the Government of the Russian Federation specified in the subitem "an" of Item 3 of this resolution, assessment of conformity of estimated cost of capital construction project, the construction or reconstruction of which is financed fully or partially by means of the federal budget, to standard rates in the field of estimate regulation and pricing is carried out along with conducting state examination of the project documentation of the corresponding capital construction project by bodies (public institutions) performing this examination and in the conclusion of state examination results of the carried-out assessment are reflected. The payment for carrying out the specified assessment is not levied;

j) since September 1, 2016 the project documentation and (or) results of engineering researches prepared concerning capital construction projects the construction or reconstruction of which is performed fully or partially at the expense of means of the federal budget, and also the documents necessary for conducting state examination of the project documentation and (or) results of engineering researches are represented to the public institution subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation, electronically, except as specified when the project documentation and (or) results of engineering researches contain the data which are the state secret;

k) since January 1, 2017 the project documentation and (or) results of engineering researches, and also other documents necessary for conducting state examination of the project documentation and (or) results of engineering researches are represented to the public institution subordinated to the Ministry of Construction and Housing and Communal Services of the Russian Federation, and also to the executive bodies of subjects of the Russian Federation authorized on conducting such state examination or public institutions subordinated to these bodies electronically, except as specified, when the project documentation and (or) results of engineering researches contain the data which are the state secret;

l) till January 1, 2017 in case of calculation of the amount of payment for conducting state examination of the project documentation and (or) results of engineering researches to apply the coefficient reflecting inflationary tendencies in comparison with January 1, 2001 (Ki) equal to 3,73;

m) if the estimated cost of construction, reconstruction, major repair, demolition of capital construction projects, works on preserving objects of cultural heritage (historical and cultural monuments) the people of the Russian Federation is determined using estimate standard rates, quotations, the prices, methodical and other documents in the field of pricing and estimate regulation in the field of town-planning activities which are included in the federal register of estimate standard rates till September 30, 2017 or are approved by executive bodies of subjects of the Russian Federation according to the procedure, established till July 3, 2016, check of reliability of determination of estimated cost includes studying and assessment of the calculations containing in estimate documentation for the purpose of establishment of their compliance to such estimate standard rates, quotations, the prices, methodical and other documents in the field of pricing and estimate regulation in the field of town-planning activities.
