2. This Federal Law does not determine the status of deputies, members of elected bodies of local self-government, elected officials of local self-government as specified persons (further - persons, replacement municipal positions) are not local government officers.

9) responsibility of local government officers for non-execution or improper execution of the job responsibilities;
10) extra party membership of municipal service.
The interrelation of municipal service and public civil service of the Russian Federation (further - the public civil service) is provided by means of:
1) unities of the main qualification requirements for replacement of positions of municipal service and positions of the public civil service;
2) unities of restrictions and obligations when passing municipal service and public civil service;
3) unities of requirements to training for municipal and civil service and to additional professional education;
4) accounting of years of service of municipal service in case of calculation of years of service of the public civil service and accounting of years of service of the public civil service in case of calculation of years of service of municipal service;
5) sootnositelnost of the main payment terms of work and social guarantees of local government officers and government civil servants;
6) sootnositelnost of the main conditions of the state provision of pensions of the citizens passing municipal service and the citizens passing the public civil service and also members of their families in case of loss of the supporter.
1. Position of municipal service - position in local government body which is formed according to the charter of the municipality, with the established duties on ensuring execution of powers of the local government body or person replacing municipal position.
2. Positions of municipal service are established by municipal legal acts according to the register of positions of municipal service in the subject of the Russian Federation approved by the law of the subject of the Russian Federation.
3. In case of creation and approval of the staff list of local government body the names of positions of municipal service provided by the register of positions of municipal service in subject of the Russian Federation are used.

Such positions of municipal service are replaced with local government officers by execution of an employment agreement for term of office of the specified person.

1) the highest positions of municipal service;
2) main positions of municipal service;
3) leading positions of municipal service;
4) senior positions of municipal service;
5) younger positions of municipal service.

The ratio of positions of municipal service and positions of the public civil service of the subject of the Russian Federation taking into account qualification requirements to the corresponding positions of municipal service and positions of the public civil service of the subject of the Russian Federation is established by the law of the subject of the Russian Federation.

Replacement of position of municipal service requires compliance to qualification requirements to the level of professional education, years of service of municipal service or occupational work, the direction of preparation, knowledge and abilities which are necessary for execution of job responsibilities, and also in the presence of the relevant decision of the representative of the employer (employer) - to specialty, the direction of preparation.
