1. Approve the enclosed Rules of destruction of the withdrawn or confiscated ethyl alcohol, alcoholic and alcohol-containing products, raw materials, semifinished products, in, transport, consumer pack (packaging), labels, the means of packing of consumer pack used for production of ethyl alcohol, alcoholic and alcohol-containing products, federal special brands and excise stamps (including counterfeit) for marking of alcoholic products and utilization of the withdrawn or confiscated capital processing equipment for production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and the capital processing equipment for production of ethyl alcohol which is subject to state registration.

2. Realization of the powers provided by this resolution is performed by the Federal Service on control of the alcoholic and tobacco markets within the number of employees of Service, and also budgetary appropriations provided to Service in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

3. This resolution becomes effective since September 1, 2023 and is effective till June 1, 2025.

1. These rules establish procedure for destruction of the withdrawn or confiscated ethyl alcohol, alcoholic and alcohol-containing products specified in subitems 1 - 3, the 8 and 9 Item 1 of article 25 of the Federal law "About State Regulation of Production and Turnover of Ethyl Alcohol, Alcoholic and Alcohol-containing Products and about Restriction of Consumption (Drinking) of Alcoholic Products" and (or) been subject of administrative offense (further respectively - products, the Federal Law), and also raw materials, semifinished products, in, transport, consumer pack (packaging), labels, the means of packing of consumer pack used for the production of ethyl alcohol, alcoholic and alcohol-containing products, federal special brands and excise stamps (including counterfeit) for marking of alcoholic products specified in the subitem 4 of Item 1 of article 25 of the Federal Law (further - objects), on condition of the termination of expiration date of products or warranty (recommended) storage duration (operation) of container (packaging) or in case of finding of products, objects stored in the Russian Federation authorized by the Government of the organization more than 3 years, and also utilizations of the withdrawn or confiscated capital processing equipment for production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and the capital processing equipment for production of ethyl alcohol which is subject to state registration, specified in subitems 5 and 7 of Item 1 of article 25 of the Federal Law (further - the capital processing equipment), in case of finding of the capital processing equipment stored in the Russian Federation authorized by the Government of the organization more than 3 years.

These rules do not extend to the withdrawn or confiscated products recognized as physical evidences according to the Code of penal procedure of the Russian Federation, objects and the capital processing equipment.

2. Destruction of products and (or) objects, utilization of the capital processing equipment are performed by the organization attracted by the Federal Service on control of the alcoholic and tobacco markets in accordance with the legislation of the Russian Federation about contractual system in the field of purchases of goods, works, services to ensuring the state and municipal needs (further - the organization).

3. The decision on destruction of products and (or) objects, utilizations of the capital processing equipment is accepted by authorized officers of territorial authorities of the Federal Service on control of the alcoholic and tobacco markets within 10 working days from the date of approval of the list of products and (or) objects, the capital processing equipment (further respectively - the decision, Service, the list of property).

The list of the authorized officers specified in paragraph one of this Item affirms Service.

4. The list of property quarterly, no later than January 20, on April 15, on July 15, on October 15 the current year, affirms territorial authority of Service in coordination with authorized body. Authorized bodies are territorial authority of federal executive body in subject of the Russian Federation in the territory of which there is division (official) of such territorial authority which made withdrawal of products and (or) objects, the capital processing equipment, or the executive body of the subject of the Russian Federation exercising regional state control (supervision) in the field of retail sale of alcoholic and alcohol-containing products which official made such withdrawal.
