1. Approve:

1) Rules of registration, issue, replacement, delivery, withdrawal and destruction of the certificate on return according to appendix 1 to this order;

2) certificate sample on return and requirements to its protection according to appendix 2 to this order.

2. To provide to department of consular service of the Ministry of Foreign Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Foreign Affairs of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Foreign Affairs of the Republic of Kazakhstan of data on accomplishment of the actions provided in subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of foreign affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of registration, issue, replacement, delivery, withdrawal and destruction of the certificate on return

1. These rules of registration, issue, replacement, delivery, withdrawal and destruction of the certificate by return (further – Rules) are developed according to the subitem 2) of article 27 of the Law of the Republic of Kazakhstan "About identity documents" (further – the Law) and with the subitem 69) of Item 15 of the Regulations on the Ministry of Foreign Affairs of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan No. 1118 of October 28, 2004 and determine procedure for registration, issue, replacement, delivery, withdrawal and destruction of the certificate by return.

2. The certificate on return – the identity document and confirming right of its owner to single entry into the Republic of Kazakhstan.

3. The certificate on return is drawn up by foreign institutions of the Republic of Kazakhstan (further – foreign institution):

1) to citizens of the Republic of Kazakhstan – in the cases of loss of the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan provided by international treaties and agreements of the Republic of Kazakhstan, the diplomatic or service passport of the Republic of Kazakhstan, or the expiration of their action during their stay outside the Republic of Kazakhstan;

2) to minor citizens of the Republic of Kazakhstan – in case of their birth outside the Republic of Kazakhstan;

3) to the persons without citizenship who are constantly living in the Republic of Kazakhstan – in case of loss of the certificate of the stateless person during their stay outside the Republic of Kazakhstan;

4) to refugees – in case of loss of the travel document during their stay outside the Republic of Kazakhstan;

5) to the citizens of the Republic of Kazakhstan and persons without citizenship who are constantly living in the Republic of Kazakhstan, having invalid documents for entry into the Republic of Kazakhstan or lost documents for entry into the Republic of Kazakhstan – in cases of their expulsion to the Republic of Kazakhstan, issues to the Republic of Kazakhstan or transfers to the Republic of Kazakhstan according to the international treaty on readmission ratified by the Republic of Kazakhstan.

4. For execution of the certificate on return to foreign institution are represented:

1) the statement in any form or the petition of competent authority of foreign state (in expulsion cases to the Republic of Kazakhstan or issues of the citizen of the Republic of Kazakhstan to the Republic of Kazakhstan or the person without citizenship who is constantly living in the Republic of Kazakhstan);

2) the document issued by competent authority of foreign state, the confirmatory fact of the address with the statement for loss of the identity document (in case of loss);

3) two color photos the size 3, 5kh 4,5 see;

4) the original document, the consular fee confirming payment according to the subitem 4) article 626 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget";

5) the original of one of identity documents (in the presence) or the electronic identity document provided by means of service of digital documents, and in case of its absence, the completed questionnaire statement according to appendix 1 to these rules;

6) the relevant document issued by medical institution of foreign state, the confirmatory fact of sex change (in case of sex change).

5. The certificate on return is drawn up valid up to 3 months.

6. The certificate on return is drawn up and issued based on confirmation:

1) nationality of the Republic of Kazakhstan;

2) permanent registration in the Republic of Kazakhstan;

3) the existing status of the refugee in the Republic of Kazakhstan.
