About approval of the technical regulation about safety of remedies of plants (pesticides)

According to the subitem 5) article 6 of the Law of the Republic of Kazakhstan "About protection of plants" and the subitem 1) article 8 of the Law of the Republic of Kazakhstan "About technical regulation" PRIKAZYVAYU:

1. Approve the enclosed technical regulation about safety of remedies of plants (pesticides).

2. Declare invalid the order of the Minister of Agriculture of the Republic of Kazakhstan of June 8, 2020 No. 197 "About approval of the technical regulation about safety of remedies of plants (pesticides)" (it is registered in the Register of state registration of regulatory legal acts No. 20848).

3. To provide to committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

The technical regulation about safety of remedies of plants (pesticides)

Chapter 1. Scope

1. This technical regulation about safety of remedies of plants (pesticides) (further – the technical regulation) is developed according to the subitem 5) of article 6 of the Law of the Republic of Kazakhstan "About protection of plants" (further – the Marine life protection act of plants), the subitem 1) of article 8 of the Law of the Republic of Kazakhstan "About technical regulation" (further – the Law on technical regulation) and extends to the remedies of plants (pesticides) (further – pesticides) released in the territory of the Republic of Kazakhstan and also to processes of their lifecycle.

2. The list of remedies of plants (pesticides) which are subject to obligatory confirmation of conformity in the form of obligatory certification to safety requirements of the technical regulation is specified in appendix 1 to this technical regulation.

3. Requirements of this technical regulation extend to activities of all physical persons and legal entities participating in production (formulyation), transportation, storage, realization, application and neutralization of pesticides.

Chapter 2. Terms and determinations

4. In this technical regulation the following terms and determinations are used:

1) active ingredient – biologically active part of pesticide which use in the form of various preparative forms leads to toxic impact on harmful organism, especially dangerous harmful organism, quarantine object, alien type or on growth and development of plants;

2) herbicide – the substance or mix of substances intended for prevention of emergence, for destruction or fight against undesirable types of plants;
