1. Approve the enclosed Rules of financing and monitoring of rendering special social services of social protection of the population according to appendix to this order.

2. Recognize invalid:

1) the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of August 25, 2018 No. 366 "About approval of Rules of financing and monitoring of rendering special social services in the field of social protection of the population" (it is registered in the Register of state registration of regulatory legal acts No. 17402)

2) Item 6 of the List of some orders of the acting minister of health care and social development of the Republic of Kazakhstan, the Minister of health and social development of the Republic of Kazakhstan and the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan to which changes are made the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan approved by the order of September 22, 2022 No. 383 "About introduction of amendments to some orders of the acting minister of health care and social development of the Republic of Kazakhstan, the Minister of health and social development of the Republic of Kazakhstan and the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts No. 29785).

3. To provide to social services department of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective since July 1, 2023 and is subject to official publication

Rules of financing and monitoring of rendering special social services of social protection of the population

Chapter 1. General provisions

1. These rules of financing and monitoring of rendering special social services in the field of social protection of the population (further - Rules) are developed according to the paragraph the twenty eighth the subitem 5) of article 12 of the Social Code of the Republic of Kazakhstan and determine procedure for financing and monitoring of rendering special social services in the field of social protection of the population.

2. In these rules the following concepts are used:

1) the receiver of special social services - person (family) recognized as the person in need in special social services;

2) the physical and (or) legal entities occupied in the state and non-state sectors on provision of special social services based on the license for provision of special social services;

3) individual funding plan according to obligations - monthly amounts of obligations assumed by public institution in terms of money within annual amounts of the budgetary funds intended for implementation of actions of the budget programs (subprogrammes);

4) individual funding plan on payments - monthly amounts of budgetary funds within annual amounts of the budgetary funds necessary for public institution for implementation of payments on account of accomplishment of undertaken obligations.

3. Financing of the subjects providing special social services is performed for the account:

1) budgetary funds according to the procedure, established by the legislation of the Republic of Kazakhstan;

2) means of the receiver of special social services for provision of the superguaranteed amount of special social services;

3) other sources which are not contradicting the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for financing of the subjects occupied in the state and not state sectors on provision of special social services

4. The executive body financed creates individual funding plan according to obligations and payments within the means provided according to the appropriate budget programs of regional budgets (budgets of the cities of republican value, the capital) and district (the cities of regional value) of budgets for financing of the subjects occupied in the state and not state sectors on provision of special social services of the local budget.

5. For the purpose of acquisition of special social services, local executive bodies create the budget request in compliance with the budget legislation of the Republic of Kazakhstan.

6. Payment to subjects, the special social services occupied in the state and not state sectors on provision, is made on the actual amount of the rendered special social services.

7. Financing of the subjects occupied in the state and not state sectors on provision of the special social services depending on the number of receivers of special social services includes means on:

1) compensation, allowance payments on improvement to annual paid labor leave and fees of the employer on taxes and other obligatory payments in the budget of the main workers;

2) compensation payments to the main workers;

3) surcharges to the main workers for accommodation in zones of ecological catastrophe and radiation risk;

4) expenses on acquisition of clothes, soft firm stock;
