About drug trafficking, psychotropic substances and their precursors

Chapter 1. General provisions

Article 1. Basic concepts

1.0. In this Law the following basic concepts are used:

1.0.1 drugs - the substances classified thus in the Single Convention of the UN of 1961 "About psychotropic substances", Conventions of the UN of 1971 "About psychotropic substances", Conventions of 1988 "About fight against drug trafficking of psychotropic substances" and also in the lists approved by the Law of the Azerbaijan Republic synthetic or natural substances, their medicines, including the plants incorporating narcotic substances (are their parts);

1.0.2 psychotropic substances - classified thus in the Convention of the UN of 1971 "About psychotropic substances", Conventions of 1988 "About fight against drug trafficking of psychotropic substances", and also in the lists approved by the Law of the Azerbaijan Republic synthetic or natural substances, their medicines;

1.0.3 precursors - chemicals, and their salts used for production of drugs and psychotropic substances and also the chemicals and their salts referred to the above-stated category by the legislation of the Azerbaijan Republic for which import, export, transit transportation and production the license (special permission) is required.

1.0.4 drug trafficking of psychotropic substances and their precursors - import to the territory of the Azerbaijan Republic (import), export from the territory of the Azerbaijan Republic (export) or transit transportation of drugs, psychotropic substances and their precursors which turnover is controlled is limited or forbidden (further it is controlled) according to the procedure, established by the legislation of the Azerbaijan Republic, and also storage, application, carrying, delivery, destruction, the use of these drugs and carrying out other transactions in their relation, stipulated by the legislation the Azerbaijan Republic;

1.0.5 drug trafficking, psychotropic substances and their precursors - any actions connected by drugs, psychotropic substances and their precursors, made with abuse of regulations, established by the legislation of the Azerbaijan Republic.

1.0.6. illegal cultivation of the plants containing narcotic substances, – landing or cultivation of the plants containing narcotic substances, with abuse of regulations, established by the legislation of the Azerbaijan Republic;

1.0.7. illegal manufacture of narcotic substances and psychotropic substances - irrespective of method of implementation of action, directed to direct production of drugs, good and unsuitable to use, and psychotropic substances, i.e. on production, conversion, purification of drugs and psychotropic substances, or receipt of drugs or psychotropic substances by the transformation of one drug or psychotropic substance into other drug or psychotropic substance or strengthenings of their impact, cultivation of the plants containing narcotic substances, receipt of drugs or psychotropic substances with abuse of regulations, established by the legislation of the Azerbaijan Republic;

1.0.8. illegal transportation or supply of drugs or psychotropic substances - all actions, irrespective of implementation method, directed to movement of drugs or psychotropic substances on the face, mail, vehicles, by means of person, not informed that the transported subject is drug or psychotropic substance, or other ways to abuse of regulations, established by the legislation of the Azerbaijan Republic;

1.0.9. illegal acquisition of drugs, psychotropic substances and their precursors - irrespective of implementation method, all actions directed to acquisition, acceptance as gift or means of settlement, exchange for other goods and things, assignment of the drugs, psychotropic substances and their precursors or acquisition by their any other methods in abuse of regulations established by the legislation of the Azerbaijan Republic;

1.0.10. illegal storage of drugs and psychotropic substances - irrespective of the purpose all actions directed to storage by person at the order of the drugs and psychotropic substances which are under its authority, in abuse of regulations, established by the legislation of the Azerbaijan Republic;
