About approval of Rules of the organization and financing of measures for assistance to entrepreneurial initiative

1. Approve the enclosed Rules of the organization and financing of measures for assistance to entrepreneurial initiative according to appendix 1 to this order.

2. Recognize invalid some orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to department of employment of the population of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the organization and financing of measures for assistance to entrepreneurial initiative

Chapter 1. General provisions

2. In these rules the following concepts are used:

1) authorized body in the field of development of agro-industrial complex – the state body performing state regulation in the field of development of agro-industrial complex;

2) unified information system of the social and labor sphere (further – AIS "Labor market") – the object of informatization intended for automation of activities of authorized state body concerning employment of the population, local executive bodies concerning social protection and employment of the population, the centers of labor mobility, career centers, the Center of development of manpower and interdepartmental interaction for the purpose of provision of the state services to the population in the social and labor sphere;

3) starting business (startup project) – business projects of participants which term of state registration as the individual entrepreneur constitutes at the time of the appeal to the organization of microcredit or to the confided (agent) behind the microcredit less than one year;

4) the center of labor mobility – the legal entity created by local executive body of area, city of republican value and the capital for the purpose of development and implementation of measures of assistance of employment;

5) close relatives are parents (parent), children, adoptive parents (adopters), the adopted (adopted), full and not full brothers and sisters, the grandfather, the grandmother, grandsons;

6) the unemployed – the physical person performing job search and ready to get to work;

7) credit partnership (further – KT) – the legal entity created by physical and (or) legal entities for requirements satisfaction of his participants in the credits and other financial, including banking services by accumulation of their money and at the expense of other sources which are not forbidden by the legislation of the Republic of Kazakhstan;

8) career center – the branch of the center of labor mobility performing accomplishment of its functions in areas, the cities of regional and republican value, the capital;

9) the organization of microcredit – the affiliated organization of joint-stock company "National managing holding "Bayterek", authorized on crediting;

10) the confided (agent) – person who on the basis of the agreement of the order makes from name and at the expense of local executive body and according to its instructions the certain orders connected with the budget crediting;

11) local executive body concerning social protection and employment of the population – the local executive body of area, the cities of republican value, the capital determining the directions in the sphere of social protection and employment of the population;

12) authorized body concerning employment of the population – the central executive body performing management and cross-industry coordination in the sphere of social protection of the population according to the legislation of the Republic of Kazakhstan, regulation, control functions behind activities of the State Social Insurance Fund.

Chapter 2. Procedure for the organization of measures for assistance in entrepreneurial initiative

Paragraph 1. Procedure for training in bases of entrepreneurship

3. To bases of entrepreneurship persons which are are trained:

1) unemployed;

3) independently performing activities for production (realization) of goods, performance of works and rendering services for the purpose of commercialization without registration as the individual entrepreneur, and (or) the idle individual entrepreneurs;

4) independently performing unpaid activities in family entrepreneurship;

5) independently performing activities for production in personal subsidiary farm for sale (exchange), with the income is lower than the size of subsistence minimum;

6) members of production cooperatives with the income is lower than the size of subsistence minimum;

7) the beginning and/or acting individual entrepreneurs.

4. For training in bases of entrepreneurship of person, corresponding to Item 3 of these rules, are registered on the business.enbek.kz portal (further – the Portal).
