The Cabinet of Ministers of Ukraine decides:

1. Approve the enclosed Rules of consumer services of the population.

2. Bring the enclosed changes in resolutions of the Cabinet of Ministers of Ukraine.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

Rules of consumer services of the population

General provisions

1. These rules determine the main requirements to consumer services of the population and establish features of regulation of the relations between the consumer and the contractor in provision of household services in the territory of Ukraine.

Action of these rules extends to the relations in the field of consumer services according to service provision agreements, performance of works (consumer work), hiring (lease), hire and to other agreements by agreement of the parties (further - the agreement).

2. In these rules terms are used in the following value:

object of provision of household services - specially equipped places for provision of household services located in separate fixed constructions, rooms of fixed constructions or in shoddy constructions for implementation of business activity according to the legislation;

consumer services of the population - the business activities of contractors connected with provision of household services;

the consumer services out of object of provision of household services servicings performed with the consent of the consumer in the place another than object of provision of household services (at home at the consumer or in other place specified by the consumer), or remotely (on the website, part of the website, in appendix, etc., in a different way, including in catalogs, prospectuses, booklets, etc.);

household service - type of the economic activity performed by the contractor by the individual order of the consumer for satisfaction of his personal household needs both in object of provision of household services and beyond its limits.

The terms "consumer" and "contractor" are used in the value given in the Law of Ukraine "About consumer protection", the term "shoddy construction for implementation of business activity" - in the value given in the Law of Ukraine "On regulation of town-planning activities".

3. Activities for provision of household services are regulated by the Tax code of Ukraine, the Economic code of Ukraine and the Civil code of Ukraine, the Laws of Ukraine "About consumer protection", "About electronic commerce", "About application of registrars of settlement transactions in the field of trade, public catering and services", "About labor protection", "About ensuring sanitary and epidemic wellbeing of the population", "About state registration of legal entities, physical persons - entrepreneurs and public forming", "About state regulation of production, production and use of precious metals and gemstones and control of transactions with them", other acts of the legislation, and also these rules.

4. The operating mode of objects of provision of household services is set by the contractor independently, except objects of provision of the household services relating to utility property of the corresponding territorial communities which operating mode is set by executive bodies of village, settlement, city councils.

In case of the temporary termination of activities of object of provision of household services for holding sanitary actions, repair, technical re-equipment and other works the contractor shall inform the consumer at least three days before the temporary termination of activities, on date and term during which activities will not be performed.

5. On facade of subject to rendering household services the sign with indication of the name of the contractor is placed. At entrance to object of provision of household services information on operating mode in a visible place is placed.

6. The contractor shall:

observe the set operating mode;

provide to the consumer necessary, available, reliable and timely information about household services;

provide compliance of object of provision of household services, the equipment and equipment to health requirements, requirements for labor protection and fire safety;

provide availability of the regulatory legal acts governing the relations in the field of provision of household services, the technology documentation on provision of household services and observance of their requirements by workers providing household services;

provide matching of workers with necessary skill level, observance of the rights of the consumers established by the legislation;

create conditions for preserving the products and materials accepted from the consumer and to use them for designated purpose;

warn the consumer about circumstances, independent of the contractor, which can worsen properties of household service in case of the essential growth of cost of household service, than it was possible to expect in case of the conclusion of the agreement;

receive from the consumer consent in case of need to accomplishment of the additional household services which are not provided by terms of the contract;

observe order fulfillment terms;

fulfill warranty obligations on the provided household services;

provide possibility of use of electronic means of payment when implementing calculations for the provided household services according to the legislation;

perform consumer services according to requirements of these rules, other regulatory legal acts and terms of the contract.

Consumer service is performed in state language according to the Law of Ukraine "About ensuring functioning of Ukrainian as state". At the request of the consumer its personal servicing can be performed also in other language acceptable for the parties.
