According to subitems 265) and 271) of Item 14 of the Regulations on the Ministry of Justice of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 28, 2004 No. 1120, I ORDER:

1. Approve enclosed:

1) Rules of maintaining the State register of regulatory legal acts of the Republic of Kazakhstan, Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) the Instruction for forming of Reference control bank of regulatory legal acts of the Republic of Kazakhstan, and also introduction of data in it.

2. Recognize invalid some orders of the Minister of Justice of the Republic of Kazakhstan according to appendix to this order.

3. To provide to department of legal policy of the Ministry of Justice of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order;

2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Justice of the Republic of Kazakhstan.

5. This order becomes effective after day of its first official publication.

Rules of maintaining the State register of regulatory legal acts of the Republic of Kazakhstan, Reference control bank of regulatory legal acts of the Republic of Kazakhstan

1. General provisions

1. These rules of maintaining the State register of regulatory legal acts of the Republic of Kazakhstan, Reference control bank of regulatory legal acts of the Republic of Kazakhstan (further – Rules) are developed according to the subitem 265) of Item 14 of the Regulations on the Ministry of Justice of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 28, 2004 No. 1120, and determine procedure for maintaining the State register of regulatory legal acts of the Republic of Kazakhstan, Reference control bank of regulatory legal acts of the Republic of Kazakhstan.

2. The basic concepts used in these rules:

1) the State register of regulatory legal acts of the Republic of Kazakhstan (further – the State register) – the single system of the state accounting of regulatory legal acts of the Republic of Kazakhstan containing details of regulatory legal acts and other data of directory nature on these acts;

2) Reference control bank of regulatory legal acts of the Republic of Kazakhstan (further – Reference control bank) – set of regulatory legal acts on paper and electronic system of regulatory legal acts in electronic form, data on which are entered in the state register of regulatory legal acts of the Republic of Kazakhstan;

3) electronic document management system – system of exchange of electronic documents, the relations between which participants are governed by the Law of the Republic of Kazakhstan "About the electronic document and the digital signature" and other regulatory legal acts of the Republic of Kazakhstan;

4) the digital signature - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. The state register and Reference control bank are created for the purpose of ensuring single state accounting of regulatory legal acts of the Republic of Kazakhstan.

4. Maintaining the State register and Reference control bank performs the republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" of the Ministry of Justice of the Republic of Kazakhstan (further – IZPI).

5. The regulatory legal acts brought in Reference control bank are subject to accounting in chronological procedure.

6. For the regulatory legal acts brought in Reference control bank, storage duration permanent.

7. Regulatory legal acts marked "For office use", "Without publication in seal", "Not for seal" are placed in Reference control bank in electronic form in the form of details according to subitems 2), 3), 4), 5), 6), 7) of article 22 of the Law.

Regulatory legal acts with signature stamp of "special importance", "top secret", "confidentially" are not subject to inclusion in the State register and Reference control bank.

Chapter 2. Procedure for maintaining the State register and Reference control bank

8. Copies of regulatory legal acts of the President of the Republic of Kazakhstan, the President of the Security Council of the Republic of Kazakhstan, Parliament of the Republic of Kazakhstan and its chambers, the Constitutional Court of the Republic of Kazakhstan and the Supreme Court of the Republic of Kazakhstan go state bodies to IZPI in paper and electronic type within ten calendar days from the date of signing in one copy in the Kazakh and Russian languages certified by seal of state body and certified by the digital signature of person, representative to sign the regulatory legal acts specified in article 35 of the Law.

Regulatory legal acts of the Government of the Republic of Kazakhstan go to IZPI only in the form of the electronic documents certified by the digital signature of person, representative to sign the regulatory legal acts specified in article 35 of the Law.
