1. Approve the enclosed Rules of payment of tourist fee for foreigners.

2. To provide to committee of the industry of tourism of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within three working days after enforcement of this order placement it on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan;

3) within three working days after execution of the actions provided by this Item, submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of actions.

3. To impose control of execution of this order on the supervising vice-Minister for Culture and Sports of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of payment of tourist fee for foreigners

Chapter 1. General provisions

1. These rules of payment of tourist fee (further - Rules) are developed for foreigners according to subitem 10-4) of article 10 of the Law of the Republic of Kazakhstan "About tourist activities in the Republic of Kazakhstan" and determine payment procedure of tourist fee for foreigners.

2. In these rules the following basic concepts are used:

1) local executive body - the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

2) local representative body (further - maslikhat) - the elected body elected by the population of area, city of republican value and the capital or area (city of regional value), expressing will of the population and according to the legislation of the Republic of Kazakhstan determining the measures necessary for its realization, and controlling their implementation;

3) locations of tourists - the hotels, motels, campings, tourist centers, guest houses, rest houses, boarding houses and other buildings and constructions used for accommodation of tourists and their servicing;

4) authorized body - the central executive body performing functions of public administration in the field of tourist activities;

5) foreigners - the persons who are not citizens of the Republic of Kazakhstan and having the evidence of the belonging to nationality of other state;

6) operators of tourist fee for foreigners (further - operators) - persons providing locations of tourists, except for hostels, guest houses, rent housing in the cities and areas;

7) tourist fee for foreigners - the payment levied from tourists for every day of stay in locations of tourists, except for hostels, guest houses, rent housing in the cities and areas.

Chapter 2. Payment procedure of tourist fee for foreigners

3. The tourist fee for foreigners (further - tourist fee) is levied from tourists for every day of stay in locations of tourists, except for hostels, guest houses, rent housing in the cities and areas (further - locations).

The amount of collectable tourist fee which is subject to payment does not join in accommodation cost.

Payers of tourist fee are foreigners or the physical persons or legal entities paying accommodation of the foreigner (inviting party, tour operator).

4. According to the Law of the Republic of Kazakhstan "About local public administration and self-government in the Republic of Kazakhstan" rates of tourist fee are developed by local executive body on the basis of these rules and submitted for approval in the relevant maslikhat.

5. In locations the rate in the amount of 0 (zero) percent from stay cost is applied to tourist fee.

6. The size of rates of tourist fee is determined on the basis of up-to-date statistical data in comparison with the same period of last year.

10. Collection of tourist fee is performed by operators at the time of registration of foreigners in locations in case of presentation of the documents proving their identity by them.

11. The documents confirming the fact of payment of tourist fee are issued to the foreigners or physical, or legal entities who paid tourist fee for foreigners in case of departure of foreigners from locations by operators.

12. According to Item 5 of Article 11 of the Budget code of the Republic of Kazakhstan the tourist fee for foreigners is non-tax receipt in city budgets of republican value, the capital and areas (city of regional value).

13. Operators record the paid tourist fee and quarterly, no later than the twentieth following reporting quarter transfer the received amounts from tourist fee into the local budget.

14. The local executive body informs tourists on need of payment of tourist fee through the social networks, and also in places of general stay (stations, the airports) in the Kazakh, Russian and English languages.
