To provide to department of policy of development of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the first vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining register of subjects of social entrepreneurship

Chapter 1. General provisions

1. These rules of maintaining the register of subjects of social entrepreneurship (further – Rules) are developed according to Item 3 of article 79-4 of the Entrepreneurial code of the Republic of Kazakhstan (further – the Code) and determine procedure for maintaining the register of subjects of social entrepreneurship.

2. In these rules the following basic concepts are used:

1) the special commission – the advisory advisory body under local executive bodies of areas, cities of republican value and the capital formed of number of representatives of state bodies, National chamber of entrepreneurs of the Republic of Kazakhstan, public associations and labor unions for the purpose of consideration of the questions concerning inclusion of individual entrepreneurs and legal entities (except for subjects of big business) in the register of subjects of social entrepreneurship;

2) the register of subjects of social entrepreneurship (further – the register) – the electronic database containing the information about the individual entrepreneurs and legal entities who are subjects of social entrepreneurship in form according to appendix 1 to these rules;

3) business and identification number (further – BIN) – the unique number created for the legal entity (branch and representation) and the individual entrepreneur performing activities in the form of joint venture;

4) individual identification number (further – IIN) – the unique number created for physical person.

5) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

6) the subject of social entrepreneurship (further – SSP) – the individual entrepreneur or the legal entity (except for subjects of big business) included in the register;

7) PROGRAM STATUS WORD of the first category – SSP promoting employment of the following categories of citizens provided that following the results of the previous calendar year the annual average number of persons belonging to any of such categories (one or several such categories) among employees of SSP constitutes at least fifty percent (but at least two persons belonging to such categories), and the share of expenses on compensation of persons belonging to any of such categories (one or several such categories) in expenses on compensation constitutes at least twenty five percent:

persons with disability;

the parents and other legal representatives who are bringing up the child with disability;

pensioners and citizens of pre-retirement age (within five years before the age granting the right to retirement benefits on age);

pupils of children's villages and graduates of orphanages, boarding schools for orphan children and children without parental support, – aged up to twenty nine years;

persons exempted from serving sentence from organizations of criminal and executive (penitentiary) system – within sixty months after release;

the persons serving sentence in organizations of criminal and executive (penitentiary) system and staying on the registry in service of probation;

persons of no fixed abode;
