About approval of Rules of creation, maintaining and use of National registers of identification numbers

According to subitem 2-2) of article 6 of the Law of the Republic of Kazakhstan "About national registers of identification numbers" PRIKAZYVAYEM:

1. Approve:

1) Rules of creation, maintaining and use of the National register of individual identification numbers according to appendix 1 to this joint order;

2) Rules of creation, maintaining and use of the National register of business and identification numbers according to appendix 2 to this joint order.

2. To provide to committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this joint order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this joint order on the internal affairs of the Republic of Kazakhstan and the vice-Minister of Justice of the Republic of Kazakhstan supervising the deputy minister.

4. This joint order becomes effective after ten calendar days after day of its first official publication.

Rules of creation, maintaining and use of the National register of individual identification numbers

Chapter 1. General provisions

1. These rules of creation, maintaining and use of the National register of individual identification numbers are developed according to subitem 2-2) of article 6 of the Law of the Republic of Kazakhstan "About national registers of identification numbers" (further - the Law) and determine procedure for creation, maintaining and use of National registers of individual identification numbers (further - the Register).

Chapter 2. Procedure for creation of the Register

2. The register is created on the basis of information systems when maintaining single systems of accounting of individual identification numbers (further - IIN).

3. For the purpose of safety of information system and ensuring personal data protection the Register is divided on integration and registration and production speak rapidly.

4. In registration and production part of information system based on the data containing in statements for issue of identity documents forming of IIN is provided.

5. Integration part of information system provides realization of the following tasks:

1) updating of information databases of state bodies and exception of duplication of information;

2) enhancement of the controling mechanism and use of information resources;

3) enhancement of relations of physical persons with state bodies by means of optimization of their interaction.

Chapter 3. Procedure for maintaining Register

6. Maintaining the Register is performed by the Ministry of Internal Affairs of the Republic of Kazakhstan (further - the Ministry of Internal Affairs) by accounting and updating of the information about physical persons provided by registering bodies in the Ministry of Internal Affairs.

7. In case of issue of the certificate of birth assignment of IIN is performed as a result of entering in information system of the following necessary data:

1) surname;

2) name;

3) middle name (in case of its availability);

4) floor;

5) birth date;

6) birthplace;

7) document type;

8) document number;

9) date of issue of the document;

10) who issues the document.

8. In case of issue of identity documents, except for certificates of birth, assignment of IIN is performed as a result of entering in information system of the following necessary data:

1) surname;

2) name;

3) middle name (in case of its availability);

4) floor;

5) nationality;

6) birth date;

7) birthplace;

8) nationality country code (in case of nationality availability);

9) the portrait image (the digitized photo) and the signature;

10) birthplace;

11) document type;

12) documentation reason;

13) address data.

9. IIN is excluded from the Register in case of the death of the physical person.

10. In case of canceling of the judgment about the declaration of physical person by the dead, IIN which is earlier excluded from the Register is subject to recovery.

11. IIN is conditionally excluded from the Register:

1) after entry into force of the judgment about recognition of physical person it is unknown absent;

2) in case of departure from the Republic of Kazakhstan of the foreigners and persons without citizenship who are temporarily staying in the Republic of Kazakhstan;

2-1) in case of departure of the foreigners and stateless persons expelled from the territory of the Republic of Kazakhstan;

3) after entry into force of the judgment about adoption (adoption) in case of change of information about the adopted child, its personal data;

4) after entry into force of the judgment about the declaration of physical person the dead;

5) in case of departure of physical person out of republic limits on the permanent residence;
