1. Approve:

1) Rules of forming of the special commission according to appendix 1 to this order;

2) Regulations on the special commission according to appendix 2 to this order.

2. To provide to department of policy of development of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the first vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming of the special commission

Chapter 1. General provisions

1. These rules of forming of the special commission (further - Rules) are developed according to the subitem 42) of Item 15 of the Regulations on the Ministry of national economy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 24, 2014 No. 1011, and determine procedure for forming of the special commission created under local executive bodies of areas, cities of republican value and the capital.

2. The basic concepts used in these rules:

1) the special commission (further - the commission) - the advisory advisory body under local executive bodies of areas, cities of republican value and the capital formed of number of representatives of state bodies, National chamber of entrepreneurs of the Republic of Kazakhstan (further - National chamber of entrepreneurs), public associations and labor unions for the purpose of consideration of the questions concerning inclusion of individual entrepreneurs and legal entities (except for subjects of big business) in the register of subjects of social entrepreneurship;

2) the register of subjects of social entrepreneurship (further - the register) - the electronic database containing the information about the individual entrepreneurs and legal entities who are subjects of social entrepreneurship namely:

name of the individual entrepreneur or name and registration date of the legal entity;

identification number;

legal address (location);

date of entering into the register of subjects of social entrepreneurship;

category of the subject of social entrepreneurship.

Chapter 2. Procedure for forming of the special commission

3. For the purpose of forming of the commission annually till December 1 by the local executive body of area, city of republican value and the capital sends inquiry to state bodies, National chamber of entrepreneurs, public associations and labor unions in the territory of the corresponding administrative and territorial unit for provision of the candidate for consideration of questions of inclusion of individual entrepreneurs and legal entities (except for subjects of big business) in the register.

4. No later than ten working days from the date of receipt of request state bodies, National chamber of entrepreneurs, public associations and labor unions present the candidate for inclusion in structure of the commission.

5. The structure of the commission on consideration of questions of inclusion of individual entrepreneurs and legal entities (except for subjects of big business) in the register affirms the decision of the akim of the relevant local executive body of area, city of republican value and the capital no later than December 31.

6. The commission consists of the chairman, the vice-chairman and his members.

7. The structure of the commission is created of number of representatives of non-profit organizations and state bodies. At the same time the number of representatives from state bodies makes at least four people and cannot exceed the number of representatives from non-profit organizations.

8. The commission is headed by the chairman elected by members of the commission at its first meeting.

9. The commission chairman cannot be the representative of state bodies.

10. During absence of the chairman of its function the vice-chairman who cannot be the representative of state bodies carries out.

The vice-chairman is appointed the commission chairman on the first commission session.

11. For the purpose of the effective organization of activities of the commission the secretary is appointed.

12. The secretary of the commission is the representative of working body. The secretary is not member of the commission and has no right to vote in case of adoption of decisions by the commission.

Chapter 1. General provisions

1. This Regulations on the special commission (further - the Provision) are developed according to the subitem 42) of Item 15 of the Regulations on the Ministry of national economy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 24, 2014 No. 1011, and determine the status and powers of the special commission (further - the commission) created under local executive bodies of areas, cities of republican value and the capital.

2. The commission in the activities is guided by the Constitution, the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, and also this Provision. The commission organizes the work on the principles of openness, publicity, collective nature and impartiality.
