1. Approve:

The regulations on the conditions and procedure for money transfer received from provision according to employment contracts of premises of the citizens obliged to refund expenses on content of the children who are on the state providing, being owners of these premises on repayment of expenses on content of their children (are applied);

the standard agreement of hiring of premises (part of the premises) belonging to the obliged persons on the property right (is attached).

2. The Item is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 02.07.2020 No. 391

3. To republican state bodies to bring the regulatory legal acts into accord with this resolution in a month.

4. This resolution becomes effective since January 1, 2007.

Regulations on the conditions and procedure for money transfer received from provision according to employment contracts of premises of the citizens obliged to refund expenses on content of the children who are on the state providing, being owners of these premises on repayment of expenses on content of their children

1. This Provision establishes conditions and procedure for money transfer, the premises received from provision on employment contracts, on repayment by the citizens obliged to refund expenses on content of the children who are on the state providing (further - the obliged persons), the being owners of these premises, expenses on content of their children.

2. The premises (part of premises in the form of the isolated living room) belonging on the property right to the obliged person are provided district, city by executive committees, local administration of the area in the city to other citizens (further - the employer) for accommodation according to the employment contract of premises (part of premises). For provision of the premises belonging to the obliged person on the property right, the power of attorney of such person is not required. At the same time:

2.1. the amount of rent of the premises belonging on the property right to the obliged person is determined by agreement of the parties employment contracts of premises (part of premises) with inclusion in it of payment for housing and communal services and payments for use of premises, and also the refunded expenses of the organizations performing operation of housing stock and (or) providing housing and communal services on the electric power consumed on lighting of auxiliary rooms and operation of the equipment, including elevators in apartment apartment houses;

2.2. the payment for housing and communal services according to the employment contract of premises (part of the premises) belonging to the obliged persons on the property right is brought according to the procedure and the terms established by the legislation;

2.3. the payment for use of premises according to the employment contract of premises (part of the premises) belonging to the obliged persons on the property right is subject to transfer by the employer to the 25th of current month on the current account on accounting of budgetary funds of district, city executive committees, local administration of the area in the city;

2.4. the payment for use of premises transferred into the current account of district, city executive committees, local administration of the area in the city according to subitem 2.3 of this Item monthly to the 27th of current month is transferred by this body into current accounts for accounting of budgetary funds:

district, city, district departments of education in the city through which organizations of education, tutorial, foster homes, orphanages of family type, children's villages (towns) in which there are children of the obliged persons are financed;

the organizations of education financed through departments of education of regional executive committees, Committee on Education of the Minsk Gorispolkom, the Ministry of Education, other republican state bodies in which there are children of the obliged persons;

houses boarding schools for handicapped children with features of psychophysical development in which there are children of the obliged persons;

children's homes in which there are children of the obliged persons.

3. The Item is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 02.07.2020 No. 391

Organizations of education or department of education, the house boarding schools for handicapped children with features of psychophysical development, children's home (further – receivers of means) monthly to the 30th of current month transfer 2 this provision of means received into current accounts according to subitem 2.4 of Item on account of expense recovery on content of children in the income of the relevant budget from which expenses on content of organizations in which there are children of the obliged persons, and also tutorial and foster homes are financed.

If the amount of payment for use of the premises belonging on the property right to the obliged person and the funds transferred by parents or collected by a court decision in expense recovery, spent by the state for content of the children who are on the state providing exceeds the size of expenses of the state, the excess amount monthly to the 30th of current month is transferred by receivers of means to the obliged person.
