About temporary movement (evacuation) of the children and persons living or enlisted in organizations of different types, patterns of ownership and subordination on the round-the-clock stay and their return

The Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for temporary movement (evacuation) for the children and persons living or enlisted in organizations of different types, patterns of ownership and subordination on the round-the-clock stay, and their return in the place of permanent residence (stay), and in case of departure out of limits of Ukraine - to Ukraine which is applied.

2. Bring in the Procedure for production by guardianship and custody bodies of the activities connected with protection of the rights of the child approved by the resolution of the Cabinet of Ministers of Ukraine of September 24, 2008 No. 866 "Questions of the activities of guardianship and custody bodies connected with protection of the rights of the child" (The Official Bulletin of Ukraine, 2008, No. 76, Art. 2561; 2022, No. 27, the Art. 1484, No. 41, the Art. 2227), the enclosed changes.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

4. Regional, Kiev city to military authorities:

take measures to temporary movement (evacuation) of children and persons according to the Procedure approved by this resolution;

together with National social customer service, the Ministry of Health, the Ministry of Education and Science, the Ministry of Defence, the Ministry of youth and sport, the Ministry of Culture and information policy to determine the organizations, institutions and organizations in which the children and persons who are subject to temporary movement (evacuation) according to the Procedure approved by this resolution can be temporarily placed (in case of impossibility to provide temporary movement (evacuation) of children and persons within area, Kiev in the place of permanent arrangement of institution);

determine in case of need institutions, organizations, the organizations for the temporary placement and stay no more than seven calendar days of children which was left without parent guardianship to the solution of question of their temporary device performed according to Procedure for production by guardianship and custody bodies of the activities connected with protection of the rights of the child approved by the resolution of the Cabinet of Ministers of Ukraine of September 24, 2008 No. 866 "Question of the activities of guardianship and custody bodies connected with protection of the rights of the child" (Official Bulletin of Ukraine, 2008, No. 76, Art. 2561), and/or temporary movement (evacuation) and to provide enough workers for ensuring leaving and education of children.

5. To the ministry of questions of reintegration of temporarily occupied territories, National police, Public service of emergency situations together with regional, Kiev city military authorities to determine safe routes of temporary movement (evacuation) of the children and persons living or enlisted in organizations of different types, patterns of ownership and subordination on the round-the-clock stay and who are subject to temporary movement (evacuation) according to item 4 of this resolution.

6. Provide to national social customer service control of temporary movement (evacuation) of children and persons according to item 4 of this resolution.

7. To the ministry of questions of reintegration of temporarily occupied territories, National police, Public service of emergency situations, regional, Kiev city to military authorities to inform quarterly to the 5th day of the next month National social customer service on condition of accomplishment of this resolution.

National social customer service provide quarterly to the 25th day of the next month to the Coordination headquarters concerning protection of the rights of the child in the conditions of warlike situation summarized information on condition of accomplishment of this resolution.

Procedure for temporary movement (evacuation) for the children and persons living or enlisted in organizations of different types, patterns of ownership and subordination on the round-the-clock stay and their returns in the place of permanent residence (stay), and in case of departure out of limits of Ukraine-in Ukraine

General questions

1. This Procedure determines the mechanism of safety of the children and persons living or enlisted on the round-the-clock stay in organizations of different types, patterns of ownership and subordination (further - children and persons), during warlike situation by acceptance in case of need died to their temporary movement (evacuation), ensuring placement, proper leaving, education, and also return in the place of their permanent residence (stay), and in case of departure out of limits of Ukraine - to Ukraine.

2. Action of this Procedure extends to such organizations of different types, patterns of ownership and subordination as children's homes (in particular, specialized), the centers of medical rehabilitation and palliative care to children; organizations of preschool and general secondary education (in particular, orphanages, sanatorium, special facilities of general secondary education, organization of specialized education with boards (nursing homes) in their structure); small group houses; shelters for children, the centers of social psychological recovery of children, the centers of social support of children and families, stationary services (departments) of the centers of the social services performing social psychological recovery of children, stationary services (departments) of social psychological recovery of children (rendering services in social psychological recovery to the children who are in difficult vital circumstances) of the centers of provision of social services; schools and professional schools of social resettlement; children's houses nursing homes of system of social protection of the population; psychoneurological nursing homes; department of stationary leaving of the territorial centers of social servicing (provision of social services); department of provision of social services in the conditions of the round-the-clock stay / accommodation of the centers of provision of social services; geriatric boarding houses; houses nursing homes for citizens of advanced age and persons with disability, the specialized houses for veterans of war and work, citizens of advanced age and persons with disability, other organizations (in particular, based by the public, charitable and religious organizations) in which accommodation or the round-the-clock stay of children and persons is provided (further - institutions).

3. Financing of the expenses connected with temporary movement (evacuation) and return of children and persons is performed at the expense of founders of organizations, and also other sources which are not prohibited by the legislation.

Content of children and persons who were temporarily moved (are evacuated) within Ukraine, it is performed at the expense of means of the founder of institution from whom they were moved, and other sources which are not prohibited by the legislation.

Temporary movement (evacuation) of children and persons

4. Temporary movement (evacuation) of children and persons from organizations is performed by results of assessment of security status of stay of children and persons in organizations which is carried out regional, Kiev city by military authorities in interaction with the relevant district military authorities, executive bodies of village, settlement, city councils (military authorities of settlements) in the place of permanent arrangement of organizations, and includes:

1) carrying out information analysis of Armed Forces, the Ministry of Defence, Ministry of Energy, territorial authorities of GSChS, National police about the territory of possible fighting, the territory where fighting, and about long absence of electrical energy and heating is conducted;

2) determination of distance from institution to the subjects of managing which are important for national economy and defense of the state;

3) determination of distance from institution to administrative border between temporarily occupied territory and other territory of Ukraine where fighting, lines of fighting collision, frontier of Ukraine with the Russian Federation, the Republic of Belarus is not conducted;

4) carrying out verification of presence and condition of protective constructions of civil protection, constructions of dual purpose suitable for the shelter of children and persons.
