Chapter 1. Basic provisions

Article 1. Scope of this Law

1. This Law establishes the principles and procedure for application by the Republic of Belarus of special rationing measures, and also measures for removal of obstacles in protection of the rights, freedoms and legitimate interests of the Republic of Belarus, her citizens and the organizations in connection with unfriendly actions of foreign states.

2. The purpose of this Law is protection of national interests and safety of the Republic of Belarus, its sovereignty and territorial integrity, political and economic stability, the rights, freedoms and legitimate interests of citizens and the organizations of the Republic of Belarus.

3. Operation of this Law does not extend to the relations arising in connection with application of other measures directed to protection of national interests and safety of the Republic of Belarus, its sovereignty and territorial integrity, political and economic stability, the rights, freedoms and legitimate interests of citizens and the organizations of the Republic of Belarus and settled by other legal acts if other is not provided by these legal acts.

Article 2. Special rationing measures and legal basis of their application

1. Special rationing measures are understood as the special measures of economic nature and other measures of counteraction which are not connected using force or threat of force, accepted according to the procedure, established by this Law, directed to exception (minimization) of negative effects of unfriendly actions of foreign states concerning the Republic of Belarus, her citizens and (or) the organizations.

2. The legal basis of application of special rationing arrangements are the Constitution of the Republic of Belarus, the conventional principles and rules of international law, this Law, regulatory legal acts of the President of the Republic of Belarus, Council of Ministers of the Republic of Belarus.

Article 3. Subjects to application of special rationing measures

1. Special rationing measures can be applied to the following objects (further - subjects to application of special rationing measures):

the foreign states making unfriendly actions concerning the Republic of Belarus, her citizens and (or) the organizations;

persons from the foreign states making unfriendly actions - the foreign persons connected with the foreign states making unfriendly actions concerning the Republic of Belarus, her citizens and (or) the organizations (including if such foreign persons have nationality of these states, the place of their registration, the place of preferential conducting economic activity by them or the place of preferential extraction by them of profit on activities are these states), and persons who are under control of the specified foreign persons, irrespective of the place of their registration or the place of preferential conducting economic activity by them.

2. Citizens and (or) the organizations of the Republic of Belarus cannot be subjects to application of special rationing measures.

Article 4. Bases for application of special rationing measures

1. Special rationing measures are applied in case of making by foreign state of the unfriendly actions including which are expressed in application of the unilateral rationing arrangements as means of economic and (or) political coercion which are not authorized by the Security Council of the United Nations and (or) incompatible with the principles and rules of international law.

2. Unfriendly actions are understood as the actions of discrimination nature made by foreign state against national interests and safety of the Republic of Belarus, its sovereignty and territorial integrity, political and economic stability, the rights, freedoms and legitimate interests of citizens and (or) the organizations of the Republic of Belarus, causing damage to the Republic of Belarus, her citizens and (or) the organizations.

Article 5. Principles of application of special rationing measures

1. The principles of application of special rationing measures are the principles of legality, publicity, justification and objectivity, proportionality, efficiency.

2. Application of special rationing measures shall be based on this Law and not contradict it (the principle of legality).

3. Information on application of special rationing measures and their content shall be publicly available, decisions on application and on cancellation of special rationing measures are subject to official publication (the principle of publicity).

4. Special rationing measures shall be applied reasonably, in case of objective availability of the fact of making of unfriendly actions to the Republic of Belarus, her citizens and (or) the organizations (the principle of justification and objectivity).

5. Effects of the applied special rationing measures shall be proportional to effects of unfriendly actions, application of special rationing measures shall not go beyond necessary and shall correspond to the circumstances which formed the basis for their application (pro-rata rule).

6. Application of special rationing measures shall be performed with exception (minimization) of negative effects of such application for the Republic of Belarus, her citizens and the organizations (the principle of efficiency).

Chapter 2. Special rationing measures, requirements to them, procedure for their application

Article 6. Types of special rationing measures

1. Making of the actions determined according to this Law concerning subjects to application of special rationing measures belongs to special rationing measures.

2. As special rationing measures can be applied:

establishment of prohibitions or import restrictions on the territory of the Republic of Belarus and realization in the territory of the Republic of Belarus of separate groups of goods which country of source is the foreign state which made unfriendly actions concerning the Republic of Belarus, her citizens and (or) the organizations or producers of which are other subjects to application of special rationing measures;

establishment of prohibitions or restrictions for transit of separate groups of goods which country of source is the foreign state which made unfriendly actions concerning the Republic of Belarus, her citizens and (or) the organizations or producers of which are other subjects to application of special rationing measures;

establishment of prohibitions or restrictions of import for the territory of the Republic of Belarus of works (services) which are carried out (rendered) subjects to application special rationing measures;

establishment of prohibitions or export restrictions out of limits of the Republic of Belarus of separate groups of goods, works (services) in the foreign states which made unfriendly actions concerning the Republic of Belarus, her citizens and (or) the organizations;
