About measures for the effective organization of public administration in the sphere of transport within administrative reforms

For the purpose of ensuring execution of the Presidential decree of the Republic of Uzbekistan of January 25, 2023 No. UP-14 "About First-priority Organizational Measures for Effective Establishing Activities of Republican Executive Bodies":

1. Approve:

Priority activities of the Ministry of transport according to appendix No. 1;

The program of reorganization of organizations in system of the Ministry of transport according to appendix No. 2;

Organizational structure of the Ministry of transport according to appendix No. 3;

The priority directions of digitalization of the sphere of transport according to appendix No. 4;

"Road map" on cardinal reforming of the sphere of transport according to appendix No. 5;

The list of the functions of the Ministry of transport transferred to private sector according to appendix No. 6.

2. In structure of the Ministry of transport:

form Inspectorate for supervision in the sphere of transport under the Ministry of transport based on Inspectorate for supervision of safety of rail haulings and Inspectorate for control of quality of road-building works under the Ministry of transport with transfer of 269 established posts of the Ministry of transport;

form Institute of retraining and advanced training of personnel in the sphere of transport under the Ministry of transport in the form of educational institution based on Institute of advanced training and retraining of personnel of road transport and Training center and retraining of workers of rail transport of the legal entities having in property railway tracks under the Ministry of transport;

reorganize SUE Uzavtotranstekhnika Research and Production Center into Research Center of Transport LLC;

create the Single integrator the Digital Transport Center under the Ministry of transport in the form of public institution with the total extreme number of personnel of 36 established posts.

Determine that the Digital Transport Center is financed by the Government budget and other sources which are not forbidden by acts of the legislation. At the same time, since 2024 from the Government budget of the Republic of Uzbekistan funds in the amount of 20 billion sum are annually allocated.

3. Determine that the Ministry of transport along with the available tasks and functions:

develops drafts of regulatory legal acts concerning highways and road economy, and also regulations in the field of technical regulation in the sphere of highways and road economy on the basis of practice and documents of the International federation of consulting engineers (FIDIC);

determines the prospects of development and enhancement of highway network, creates state programs of development of highways;

develops offers on implementation of investment projects and projects of public-private partnership in the sphere of road economy;

approves the list normative and legal and the regulations in the field of technical regulation developed in the sphere of road economy and also considers drafts of these acts on Scientific and technical council under the Ministry of transport.

4. Determine that:

a) The inspectorate for supervision in the sphere of transport under the Ministry of transport is the republican executive body performing functions of supervision in spheres of road, rail, water, electric transport, the subway and road economy;

b) the following tasks are assigned to Inspectorate for supervision in the sphere of transport:

implementation within the powers of the state control of safety of transportations on road, rail, water, electric transport and the subway;

control of observance of requirements of acts of the legislation on town planning and regulations in the field of technical regulation in case of construction, reconstruction and repair of highways and artificial constructions;

control of observance of conditions of implementation of the international motor transportations provided by international treaties of the Republic of Uzbekistan;

control of work-rest schedule of drivers and workers of locomotive crews when implementing freight and passenger traffic;

control of observance of admissible weight and dimensional parameters of vehicles in the territory of the republic (except for check points through Frontier);

accounting and maintaining the unified register of infrastructure facilities and railway vehicles of the railroads by their registration;

c) In the sphere of transport for accomplishment of the tasks assigned to it the following powers are conferred to inspectorate for supervision:

hearing of cases about administrative offenses in the sphere of motor freight and passenger traffic, rail, water, electric transport, the subway and road economy and application of measures of administrative punishment;

stop of vehicles for check on stationary and mobile posts on control of freight and passenger traffic in case of identification of abuses of regulations of transportation of goods and passengers on vehicles by means of visual observation or special devices.

5. Resolve carrying out without coordination with the Representative for protection of the rights and legitimate interests of subjects of entrepreneurship, without its notification, and also without use of the risk analysis system (without intervention in financial and economic activities) the following control events:
