About approval of qualification requirements, shown to the private employment agencies applying for participation in outsourcing of services in the sphere of employment of the population

1. Approve the enclosed Qualification requirements imposed to the private employment agencies applying for participation in outsourcing of services in the sphere of employment of the population.

2. Recognize invalid:

1) the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 19, 2018 No. 254 "About approval of the qualification requirements imposed to the private employment agencies applying for participation in outsourcing of services in the sphere of employment of the population" (it is registered in the Register of state registration of regulatory legal acts at No. 17168);

2) Item 1 of the List of some orders of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan to which changes are made No. 345 approved by the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 26, 2019 "About introduction of amendments to some orders of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 18912).

3. To provide to department of employment of the population of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

The qualification requirements imposed to the private employment agencies applying for participation in outsourcing of services in the sphere of employment of the population

Chapter 1. General provisions

1. These qualification requirements are established to the private employment agencies applying for participation in outsourcing of services in the sphere of employment of the population.

2. Private employment agencies are the physical person or legal entity rendering the labor mediation registered according to the procedure, established by the legislation of the Republic of Kazakhstan.

3. The private employment agencies applying for participation in outsourcing of services in the sphere of employment of the population shall have the corresponding experience, material and the manpower sufficient for obligation fulfillment under the agreement on outsourcing of services in the sphere of employment of the population.

Chapter 2. The qualification requirements imposed to private employment agencies

4. To private employment agencies, being legal entities, applying for participation in outsourcing of services in the sphere of employment of the population the following qualification requirements are established:

1) experience in implementation of activities for rendering services in the sphere of employment of the population at least one year;

2) availability of the salaried employees consisting of the skilled list of heads, specialists having the highest (or postgraduate), technical and professional education and experience of practical work at least 1 (one) year on rendering services in the sphere of employment of the population and (or) staffing;

3) availability of material resources for obligation fulfillment under the agreement on outsourcing of the services in the sphere of employment of the population including equipment the workplaces of salaried employees, office tables, computers or laptops connected to the Internet with the established software necessary for rendering services, the printer, the photocopier and the scanner;

4) solvency and lack of tax debt, debt on social payments;

5) availability of the room or building on the property right (economic maintaining or operational management) and (or) leases placed in the office building, office and the providing proper conditions for acceptance of the unemployed;

6) availability of state registration of the legal entity in judicial authorities;

7) not to be subject to insolvency proceeding or liquidation.

5. To the private employment agencies which are the physical persons performing business activity, applying for participation in outsourcing of services in the sphere of employment of the population the following qualification requirements are established:

1) experience in implementation of activities for rendering services in the sphere of employment of the population at least one year;

2) availability at least one specialist having the highest (or postgraduate) or technical and professional education, and also at least 1 (one) year having work experience on rendering services in the sphere of employment of the population and (or) staffing;

3) availability of material resources for obligation fulfillment under the agreement on outsourcing of the services in the sphere of employment of the population including equipment the workplaces of salaried employees, office tables, computers or laptops connected to the Internet with the established software necessary for rendering services, the printer, the photocopier and the scanner;

4) solvency and lack of tax debt, debt on social payments;

5) availability of the room or building on the property right (economic maintaining or operational management) and (or) leases placed in the office building, office and the providing proper conditions for acceptance of the unemployed;

6) availability of state registration as the individual entrepreneur in tax authorities;

7) not to be subject to insolvency proceeding.
