About standardization

(as amended on 16-10-2012)

This Law establishes legal and organizational basis of standardization in Ukraine and is aimed at providing single technical policy in this sphere.

Section I. GENERAL PROVISIONS

Article 1. Main terms and their determination

In this Law terms are used in the following value:

standardization - the activities consisting in establishment of provisions for common and repeated application on the available or possible tasks for the purpose of achievement of optimum extent of streamlining in certain sphere of which increase in degree of compliance of products, processes and services to their functional purpose, elimination of barriers in trade and to assistance to sci-tech cooperation is result;

the international standardization - the standardization which is carried out at the international level and participation in which is open for relevant organs of all countries;

regional standardization - the standardization which is carried out at the appropriate regional level and participation in which is open for relevant organs of the countries of certain geographical or economic space;

national standartization - the standardization which is carried out at the level of one country;

body of standardization - the body which is engaged in standardization, recognized at the national, regional or international level which main functions are development, approval or approval of standards;

the regulating document - the document establishing rules, the general principles or characteristics of different types of activities or their results. This term covers such concepts as "standard", "the code of established practices" and "specifications";

consensus - the consensus which is characterized by lack of strong objections on vital issues at most of concerned parties and reached as a result of the procedure directed to taking into account of opinion of all parties and rapprochement of the incoincident points of view;

the standard - the document developed on the basis of consensus and approved by the authorized body establishing intended for general and reuse of the rule, the instruction or the characteristic, concerning activities or its results, including products, processes or services which observance is optional. The standard may contain the requirements to terminology, marks, packaging, marking or etiketirovka applied to certain products, process or service;

the international and regional standards - the standards accepted according to international and regional body of standardization;

national standards - the state standards of Ukraine accepted by the central executive body which provides forming of state policy in the sphere of standardization and available for a wide range of users;

the code of established practices (set of rules) - the document containing practical rules or procedures of designing, production, installation, maintenance, operation of the equipment, designs or products. The code of established practices can be the standard, part of the standard or the separate document;

specifications - the document establishing technical requirements which shall be answered products, processes or services. Specifications can be the standard, part of the standard or the separate document;

Article 2. Law coverage

This Law governs the relations connected with activities in the sphere of standardization and use of its results and extends to managing subjects irrespective of pattern of ownership and types of activity, state bodies, and also to the relevant public organizations.

Operation of this Law does not extend to nuclear materials, pharmaceutical products, standards of medical attendance, financial accounting, education, and also other social standards which coverage is established by the relevant laws.

Article 3. The legislation of Ukraine in the sphere of standardization

The legislation of Ukraine in the sphere of standardization consists of this Law and other regulatory legal acts governing the relations in this sphere.

Article 4. Subjects of standardization

Subjects of standardization are products, processes and services, in particular materials, components, the equipment, systems, their compatibility, rules, procedures, functions, methods or activities, personnel and bodies, and also requirements to terminology, designation, packing, packaging, marking, etiketirovka.

Article 5. The purpose and the basic principles of state policy in the sphere of standardization

The standardization purpose in Ukraine is ensuring rational use of natural resources, compliance of subjects of standardization to their functional purpose, informing consumers on product quality, processes and services, support of development and the international product competitiveness and trade in goods and services.

State policy in the sphere of standardization is based on the following principles:

ensuring participation of physical persons and legal entities in development of standards and the free choice of types of standards by them in case of production or delivery of products if other is not stipulated by the legislation;

openness and transparency of procedures of development and adoption of standards taking into account interests of all concerned parties, increase in product competitiveness of domestic manufacturers;

availability of standards and information on them for users;

compliance of standards to the legislation;

adaptations to modern achievements of science and technology taking into account condition of national economy;

priority of direct introduction in Ukraine the international and regional standards;

observance of the international and European rules and procedures of standardization;

participations in the international (regional) standardization;

acceptances and applications of standardization by bodies in the territory of Ukraine of the Code of charitable practice for development, acceptance and application of standards according to the Agreement of VOT on technical barriers in trade which is appendix to the Marrakesh agreement on organization of World Organization of trade of 1994.

Section II. STANDARDIZATION ORGANIZATION

Article 6. Subjects of standardization

Subjects of standardization are:

the central executive body which provides forming of state policy in the sphere of standardization;

the central executive body which realizes state policy in the sphere of standardization;

the paragraph the fourth is excluded;

technical committees of standardization;

other subjects who are engaged in standardization.
