Some questions of the organization of employment of persons with disability

According to part three of article 18 of the Law of Ukraine "About bases of social security of persons with disability in Ukraine" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for provision to public service of employment of information necessary for the organization of employment of persons with disability which is applied.

2. Bring in resolutions of the Cabinet of Ministers of Ukraine of January 31, 2007 No. 70 "Some questions of realization of regulations of the Laws of Ukraine "On bases of social security of persons with disability in Ukraine" and "About employment of the population" (The Official Bulletin of Ukraine, 2007, No. 8, Art. 282; 2009, No. 68, Art. 2346; 2010, No. 98, Art. 3488; 2019, No. 32, Art. 1158, No. 48, Art. 1641; 2021, No. 78, the Art. 4911) and of February 11, 2015 No. 96 "About approval of the Regulations on Public service of Ukraine concerning work" (the Official Bulletin of Ukraine, 2015, No. 21, Art. 584; 2020, No. 20, Art. 763; 2021, No. 86, the Art. 5488) the enclosed changes.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

4. To the ministries and other central executive bodies to bring own regulatory legal acts into accord with this resolution.

Procedure for provision to public service of employment of information necessary for the organization of employment of persons with disability

1. This Procedure determines procedure for granting the company, organization, the organization, the physical person using wage labor (further - the employer), branch of interregional/regional jobcenter (city, district, gorrayonny jobcenter - before date of the termination of their activities) (further - jobcenter) information necessary for the organization of employment of persons with disability.

2. The employer from the date of emergence at it of need for matching of workers with disability and/or from the date of discovery of vacancies on which employment of persons with disability is possible informs jobcenter for its location.

NADS submits information about the vacancies of Public service of the announcement of carrying out tenders promulgated on the Single portal to positions of public service to which employment of persons with disability is possible to public service of employment by information exchange.

3. Information necessary for the organization of employment of persons with disability, can be provided by the employer of jobcenter in electronic (with imposing or without imposing of the digital signature or seal which are based on qualified certificates of open keys) or in paper form (with the certificate the signature of the head / the physical person - the entrepreneur or person authorized by them).

4. Primary information is provided by the employer for the purpose of informing on availability of the need for employment of persons with disability.

The specifying information moves in case of need on replacement of primary and contains refining of characteristics of vacancy (vacancies), in particular working conditions, the size of the salary, requirements to the candidate (candidates). At the same time the amounts of vacancies and the professional name of works (profession/position) this relatively cannot be changed.

5. The employer can notify jobcenter on closing of vacancy (vacancies) by sending the relevant information electronically on the official e-mail address of jobcenter (with imposing or without imposing of the digital signature or seal which are based on qualified certificates of open keys) or in paper form (with the certificate the signature of the head / the physical person - the entrepreneur or person authorized by them).

6. The employer submits to jobcenter information necessary for the organization of employment of person with disability, in form of the reporting No. 3-HH determined by Ministry of Economics.

Requirements of this Item do not extend to information which NADS according to the paragraph of Item gives the second 2 presents of the Procedure.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine of January 31, 2007 No. 70 and of February 11, 2015 No. 96

1. In the resolution of the Cabinet of Ministers of Ukraine of January 31, 2007 No. 70:

The paragraph of the seventh of Item 1 of the resolution to state 1) in the following edition:

"Procedure for control over the implementation of the standard rate of workplaces and check of the companies, organizations, organizations, including companies, organizations of public associations of persons with disability, the physical persons using wage labor on accomplishment of the standard rate of the workplaces intended for employment of persons with disability, in particular by its transfer.";
