About approval of the Regulations on information interaction of authorized institutions concerning accounts of nonresidents in hryvnia and modification of the Regulations on currency supervision

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 10, 11 Laws of Ukraine "About currency and currency transactions", the Law of Ukraine "About payment services", for the purpose of providing conditions for implementation by authorized institutions of currency supervision of transactions in the hryvnias performed by subjects of currency transactions through these organizations, and enhancement of implementation by authorized institutions of currency supervision of Board of the National Bank of Ukraine DECIDES:

1. Approve Regulations on information interaction of authorized institutions concerning accounts of nonresidents in hryvnia (further - Regulations on information interaction) which are applied.

2. Item 8 of the Section I of the Regulations on currency supervision approved by the resolution of Board of the National Bank of Ukraine of January 03, 2019 No. 13 (with changes) to state in the following edition:

"8. Authorized institutions during currency transactions shall consider requirements of regulatory legal acts of National Bank concerning implementation by authorized institutions of the analysis and verification of documents (information) on currency transactions and concerning information interaction of authorized institutions as agents of currency supervision by exchange of information about accessory of accounts in hryvnia of the clients/users opened in these organizations to bank/payment accounts which owners are nonresidents.".

3. The authorized institution on the basis of the program platform provided by the National Bank of Ukraine for creation of the automated information system "Account Register of Nonresidents" (further - the Register) independently provides setup, testing, completion of the systems of automation and automation of necessary processes for the organization of provision in the Register of information on accessory of accounts in hryvnia of the clients/users opened in this organization to bank/payment accounts which owners are nonresidents, and receipts of information containing in the Register according to Regulations on information interaction.

4. From August 01 to December 31, 2023:

1) the Register functions only for provision by authorized institution of information on all bank/payment accounts in hryvnia opened by nonresidents in this organization (except accounts which were closed before entry into force of this resolution);

2) the authorized institution shall provide provision in the Register of information on accessory of accounts in hryvnia of the clients/users opened in this organization to bank/payment accounts which owners are nonresidents, according to the procedure established by Regulations on information interaction.

5. The authorized institution has the right to obtain from the Register information on accessory of accounts in hryvnia of clients/users of other authorized institutions to bank/payment accounts which owners are nonresidents, for implementation of currency supervision of transactions in hryvnia of the clients / users if subjects of such currency transactions are clients/users of various authorized institutions, since January 01, 2024.

6. The resolution becomes effective from the date of, its official publication following behind day, except:

1) Item 1 of this resolution which becomes effective since August 01, 2023;

2) Item 2 of this resolution which becomes effective since January 1, 2024.

Regulations on information interaction of authorized institutions on accounts of nonresidents in hryvnia

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About currency and currency transactions", "About payment services" for ensuring exchange of information between authorized institutions as agents of currency supervision about accessory of accounts in hryvnia of the clients/users opened in these organizations to bank accounts / to payment accounts which owners are nonresidents, for the purpose of implementation of currency supervision of the currency transactions performed through these organizations.

2. The terms used in this Provision are used in the following values:

1) the automated information system "Account Register of Nonresidents" (further - the Register) - the automated information system providing collection, accumulating, storage, change, general access and receipt by authorized institutions of information on accessory of accounts in hryvnia of clients/users of this organization to bank accounts / to payment accounts which owners are nonresidents (dalee-Information on the account);

2) account number according to the standard IBAN bank account number which is created according to the resolution of Board of the National Bank of Ukraine of December 28, 2018 No. 162 "About introduction of the international bank account number (IBAN) in Ukraine" (with changes) or the payment account which is created according to the resolution of Board of the National Bank of Ukraine of July 26, 2022 No. 158 "About introduction of number of the payment account of the user and e-wallet in Ukraine";

3) procedure for the organization of provision in the Register of Information on accounts - the accurate sequence of actions on the organization of process of provision in the Register of Information on accounts (changes in Information on accounts) with indication of methods, forms, terms (terms) of the use by employees of authorized institution of the corresponding actions;

4) the account - the bank/payment account in hryvnia which owner is the nonresident.

The terms "user", "the payment account" are used in the values determined by the Law of Ukraine "About payment services".
