About approval of Rules of appointment and payment of the government address public assistance

According to the seventeenth paragraph the subitem 5) article 12 of the Social code of the Republic of Kazakhstan and the subitem 1) article 10 of the Law of the Republic of Kazakhstan "About the state services" PRIKAZYVAYU:

1. Approve the enclosed Rules of appointment and payment of the government address public assistance according to appendix 1 to this order.

2. Recognize invalid some orders of the Ministry of health and social development of the Republic of Kazakhstan, the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to department of the public assistance of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective since July 1, 2023 and is subject to official publication.

Rules of appointment and payment of the address public assistance

Chapter 1. General provisions

1. These rules of appointment and payment of the address public assistance (further – Rules) are developed according to the paragraph the seventeenth the subitem 5) of article 12 of the Social code of the Republic of Kazakhstan (further – the Code) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law) and determine procedure for appointment and payment of the address public assistance.

2. In these rules the following basic concepts are used:

1) the individual plan of the help to person (family) (further – the individual plan) – the actions plan on assistance of employment and (or) social adaptation constituted by career center together with person who addressed for rendering the address public assistance, and (or) members of his family;

2) The Government for Citizens State corporation (further - the State corporation) - the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", ensuring rendering the state services electronically;

3) the assistant – the employee of career center performing functions on rendering assistance to the consultant for social work and the akim of the settlement, village, rural district in carrying out consultation, interview, and also monitoring of accomplishment of obligations under the social contract;

4) authorized body to destination the address public assistance – the local executive body of the city of republican value, the capital, area, city of regional value, the area in the city performing purpose of the address public assistance;

5) measures of social adaptation – the complex of actions including the measures of social abilitation and rehabilitation of persons with disability determined by article 161 of the Code the special social services rendered to persons which are in needs according to the Code and also other measures state the supports given according to the procedure, stipulated by the legislation the Republic of Kazakhstan;

6) social disadaptation – violation of interaction of the personality with social environment;

7) social deprivation – restriction and (or) deprivation of possibility of independent satisfaction with person (family) of the basic vital needs;

8) the consultant for social work – the employee of career center performing assistance in purpose of the address public assistance and exit of needy person (family) from the situation caused by stay it below the poverty line;

9) the social contract – the agreement determining the rights and obligations of the Parties between the participant of active measures of assistance of employment and the center of labor mobility (career center), and in the cases provided by this Code with the physical persons or legal entities involved in the organization of active measures of assistance of employment and also about rendering the address public assistance;

10) Single contact center – the legal entity determined by authorized body in the sphere of rendering the state services, performing functions of directory service on provision to uslugopoluchatel of information on questions of rendering the state and other services and also to state bodies – information on questions of rendering information and communication services;

11) the center of labor mobility – the legal entity created by local executive body of area, city of republican value and the capital for the purpose of development and implementation of measures of assistance of employment;

12) able-bodied person (the able-bodied family member) – person or the family member aged since eighteen years to age, stipulated in Item 1 article 207 of the Code, except for persons with disability of the first or second group and (or) persons having diseases in case of which the term of temporary disability can be established more than two months;

13) the average per capita income – the share of comprehensive income of family falling on each family member in month;

14) comprehensive income – the amount of the income types considered in case of purpose of the address public assistance;

15) the standard list of actions for assistance of employment and social adaptation (further – the Standard list) – the list of active measures of assistance of employment and social adaptation approved by authorized state body in the sphere of social protection of the population, and recommended for use in case of the conclusion of the social contract;

16) the service provider – the central state bodies, foreign institutions of the Republic of Kazakhstan, local executive bodies of areas, cities of republican value, the capital, areas, cities of regional value, akims of areas in the city, the cities of district value, settlements, villages, rural districts, and also the physical persons and legal entities rendering the state services according to the legislation of the Republic of Kazakhstan;

17) career center – the branch of the center of labor mobility performing accomplishment of its functions in areas, the cities of regional and republican value, the capital;

18) authorized organization for payment of the address public assistance and monthly additional payment on each child aged from one year up to six years inclusive – the banks of the second level, the organizations having licenses of authorized body on regulation, control and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company;

19) pro-active service – the state service rendered without statement of uslugopoluchatel at the initiative of the service provider;

20) needy persons (families) are persons (family) having the average per capita income per month below the poverty line, established in areas, the cities of republican value, the capital;

21) authorized state body – the central executive body performing management and cross-industry coordination in the sphere of social protection of the population according to the legislation of the Republic of Kazakhstan, regulation, control functions behind activities of the State Social Insurance Fund;

22) the precinct election commission – the special commission created by the decision of akims of the corresponding administrative and territorial units for carrying out inspection of financial position of persons (families) which asked for the address public assistance;

23) the district (city) commission on questions of employment of the population – the commission performing coordination of activities of the state bodies and other organizations located in the territory of the area (the city of regional value), akims of the cities of district value, villages, settlements, rural districts concerning implementation of measures of assistance of employment of the population and the public assistance;

24) regional commission concerning employment of the population – the commission performing coordination of activities of the state bodies and other organizations located in the territory of the area (the city of republican value, the capital) for implementation of measures of assistance of employment of the population and the public assistance;

25) active measures of assistance of employment of the population – measure of social protection from unemployment and employment of the population, the state support of citizens of the Republic of Kazakhstan and kandas from among the unemployed, and also other persons in the cases provided by the Code;

26) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically.

Chapter 2. Procedure for purpose of the address public assistance

3. The address public assistance is provided to person or family with the average per capita income which is not exceeding the poverty line established in areas, the cities of republican value, the capital according to item 4 of article 120 of the Code in the form of the unconditional or caused monetary assistance.

For purpose of the address public assistance the family composition is determined according to Item 5 of article 120 of the Code.

4. Person (family), applying for receipt of the address public assistance, for receipt of information on procedure for purpose of the address public assistance addresses to career center at the place of residence, and in case of absence of career center at the place of residence – to the akim of the settlement, village, rural district (further – the akim).

In the absence of registration in the place of permanent residence the residence is confirmed by registration in the place of temporary stay (accommodation) within six months preceding date of the request for purpose of the address public assistance within one settlement, except for:

1) emergency situations;

2) persons in need on the following bases:

the ill treatment which led to social disadaptation and social deprivation;

homelessness (persons of no fixed abode);

release from places of detention.

In the cases provided by subitems 1) and 2) of part two of this Item, the career center or the akim for the purpose of purpose of the address public assistance assists temporary registration of the applicant in the Center of social adaptation for persons which are not taking certain residence.

1) information is provided:

about conditions of receipt of the unconditional and caused monetary assistance;

about conditions of participation in active measures of assistance of employment and (or) in programs of social adaptation;

about need of the conclusion of the social contract, obligations of the parties participating in the social contract, and conditions of termination of the social contract;

about conditions of change of the sizes and (or) the terminations of the address public assistance, including about deprivation of the right to purpose of the address public assistance within six months in the cases specified in subitems 4), 5) and 6) of article 128 of the Code;

about the list of the data requested from the corresponding information systems of state bodies and the organizations;

about possibility of submission of the documents confirming the data which are absent in the corresponding information systems of state bodies and organizations;

2) predesign of the average per capita income of person or family and the extent of the address public assistance is made.

Consultation in career the center is carried out by consultants, in case of the address of person to the akim – assistants.

6. By results of consultation, person or family (further – the applicant) from themselves personally or on behalf of family submits the application for purpose of the address public assistance in form according to appendix 1 to these rules through the service provider, the portal, the subscriber structure of cellular communication.

At the same time the applicant needs to have in case of himself the identity document (the identity certificate (passport) of the citizen of the Republic of Kazakhstan, the residence permit of the foreigner who is constantly living in the Republic of Kazakhstan, the certificate of the stateless person, the certificate of the refugee), the certificate of kandas on paper or in exchange the electronic document in the presence of it in service of digital documents – for identification.
