According to article 27 of the Law of the Republic of Tajikistan "About traffic", the Government of the Republic of Tajikistan decides:

1. Approve the Order of registration and accounting of vehicles, and also issues on them the registration certificate and the state serial numbers it (is applied).

2. To the ministries, committees and departments of the Republic of Tajikistan to bring own regulations into accord with this Procedure for state registration and accounting of vehicles, and also issues on them the registration certificate and the state serial numbers.

3. To the Ministry of Finance of the Republic of Tajikistan to provide allocation to the Ministry of Internal Affairs of the Republic of Tajikistan and Customs Service under the Government of the Republic of Tajikistan in 2000 of budgetary funds for creation of single system of state registration and accounting of vehicles, and also issue on them the registration certificate and the state serial numbers.

4. Under the Government of the Republic of Tajikistan to provide to the Ministry of Internal Affairs of the Republic of Tajikistan and Customs Service control over the implementation of requirements of this resolution.

Order of registration and accounting of vehicles, and also issue on them the registration certificate and the state serial numbers

1. Registration and accounting of vehicles (further - vehicles) it is made based on the current legislation of the Republic of Tajikistan, resolutions and other regulatory legal acts of the Government of the Republic of Tajikistan and is measure of the state permission to participation of vehicles in traffic, including international. It is performed for the purpose of ensuring supervision of compliance of design, technical condition and the equipment of vehicles to the established safety requirements, observance of procedure for acquisition, obtaining, use, alienation, write-off of vehicles, proper execution of the customs legislation and about military transport obligation, payment of the corresponding taxes and fees by owners of vehicles, ensuring centralized and regional accounting of automotor-transport, fight against crimes and other offenses.

2. Used in this Order of registration and accounting of vehicles, and also issues on them the registration certificate and the state serial numbers (further - the Procedure) concepts, have the following values:

- "state registration of vehicles" the activities of customs authorities and the State traffic inspectorate for accounting, issue of official documents and the state registration signs (further - number boards) on the vehicles confirming their admission to participation in traffic performed according to legal acts;

- "change in registration" modification and amendments in accounting data and documents on vehicles in the presence of the corresponding legal basis;

- "the owner (the owner's representative) of the vehicle" physical person and legal entity, being the owner of the vehicle, or owning or using, or disposing of the vehicle on other legal causes;

- "registration documents" - customs certificates on the vehicles, national registration certificates of single sample, log books, technical coupons, registration certificates for international movement of the established sample which are official documents on the vehicles confirming their admission to participation in traffic;

- "data on registration" - serial number, wines code, type, brand, year of manufacture, body number, chassis number, color, engine power, load-carrying capacity amount, off-load weight, the owner, the address, the registration bases, check-in location, special marks.

I. General provisions

3. This Procedure establishes procedure for state registration, single in all territory of the Republic of Tajikistan (changes in registration) and accounting of vehicles, and also regulate activities of the State traffic inspectorate and bodies of customs in the specified sphere on rendering services to legal entities and physical persons, including also paid services (registration in stipulated by the legislation procedure for documents on change of the property right to vehicles, number aggregates, etc.). All payment types and paid services provided by this Procedure are performed in non-cash form.

4. The procedure is obligatory for all companies, organizations and the organizations irrespective of patterns of ownership, citizens of the Republic of Tajikistan, foreign legal entities, foreign citizens and stateless persons - owners of vehicles and their representatives (further - owners).

5. To state registration and accounting, motorized vehicles with engine capacity more than 50 cm cubic and with a maximum constructive speed more than 40 km \hour, trail cars and semitrailer trucks to them, and also the vehicles set in motion by the electric motor, which maximum constructive speed more than 40 km/h are subject.

Owners of vehicles shall register the vehicles belonging to them, irrespective of their technical condition, within five days from the moment of crossing of border in customs authorities. In registration and examination divisions of the State automobile inspection vehicles are registered during effective period of the registration sign "Transit" or ten days from the moment of acquisition, customs clearance, removal from accounting or emergence of other circumstances attracting change of registration data (except for vehicles, held for sale the individual entrepreneurs and legal entities enabling the realization of vehicles). Bodies of the State automobile inspectorate of the Ministry of Internal Affairs of the Republic of Tajikistan after receipt of accounting cards of vehicles from registration and examination divisions of the State automobile inspection, submit to the corresponding military commissariats for statement on military accounting or removals from military accounting of the data on registration, change of registration data within week term and removal from accounting of the vehicles which are subject according to the list established by the Ministry of Defence of the Republic of Tajikistan, provision to Armed Forces of the Republic of Tajikistan, other troops, military forming and bodies, and also the special forming created on wartime.

6. Vehicles is registered only behind the legal entities and physical persons specified in the passport of the vehicle or in the reference account issued by manufacturer, trade organization, the customs certificate or other document confirming legality of acquisition by the vehicle owner.

The vehicles imported into the republic, after registration in the State automobile inspection, according to the list, approved by the Ministry of Internal Affairs of the Republic of Tajikistan, are checked on special information base.

In all cases, in case of registration of the vehicles imported in the Republic of Tajikistan the customs certificate is required. In case of statement and removal from accounting (in registration divisions) the cars classified in goods items 8702, 8703 commodity nomenclatures of foreign economic activity of the Republic of Tajikistan, which are not intended for productive or other business activity the copy of the cargo customs declaration (CCD), by the confirmed personal number seal of the service employee of the customs authority making customs clearance is also required.

7. 8. The documents submitted for making of registration actions confirming legality of acquisition of vehicles (number aggregates) shall contain: date and the place of their creation, essence and terms of transaction (the decision of state body), including vehicle cost (in case of need), addresses, details and signatures of the parties (for legal entities - the signatures certified by seal), data on the vehicle (brand, model, modification (type), year of manufacture, identification number (VIN) if it is appropriated by manufacturer, color, serial production chassis number (frames), bodies (carriages, trail car), series and number, date of issue of the registration document and (or) passport of the vehicle and the name of the organizations which issued them.

9. The documents having erasures or additions, the crossed-out words and other not stipulated corrections, i.e. the having signs of counterfeit, erasure or board of primary records, and also the records performed by pencil are not accepted to production of registration actions. The text of the specified documents shall be written clearly and accurately, surnames, names and middle names of citizens shall be written completely with indication of the place of their residence and passport data, and the name of legal entities - without reducings and with exact specifying of addresses. d) exercise control of payment by owners of vehicles of the customs payments and taxes established by the legislation of the Republic of Tajikistan.

Tax payment, duties and charges are confirmed by the receipt (payment orders) and (or) backs of receipts to the receipt order. The right to exemption of customs payments and charges is confirmed by the relevant documents stipulated by legal acts. About payment of the established taxes, duties and charges the mark in the customs declaration and the certificate, is made by the witnessed signature and seal of the employee of customs;

e) on Items of customs autotransition (on railway stations and the airports on delivery of the vehicle not under the own steam) registration signs including imported on leasing conditions, except the vehicles participating in international movement withdraw and in exchange issue transit numbers which are acquired in Management of GAI of the Ministry of Internal Affairs of the Republic of Tajikistan or regional departments of GAI.
