1. Approve Rules of implementation of accounting and assessment of pension assets according to appendix 1 to this resolution.

2. Recognize invalid regulatory legal acts of the Republic of Kazakhstan, and also structural elements of some regulatory legal acts of the Republic of Kazakhstan according to the list according to appendix 2 to this resolution.

3. To provide to department of the security market in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.

4. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.

5. This resolution becomes effective since July 1, 2023 and is subject to official publication.

Rules of implementation of accounting and assessment of pension assets

Chapter 1. General provisions

2. For the purposes of Rules the following concepts are used:

1) book value of shares - the share value determined based on the financial reporting of the issuer of these shares according to stock exchange rules;

2) the appraiser - the organization performing activities for property assessment based on licenses (except for intellectual property items, the cost of intangible assets) and (or) assessment of intellectual property, cost of intangible assets;

3) nominal value of the debt financial instrument - the monetary value of cost of the debt financial instrument determined in case of its release on which the remuneration expressed as a percentage, and also the amount which is subject to payment to the holder of the debt financial instrument in case of its repayment is charged. Nominal value of the debt financial instrument is determined based on the prospectus of release of this debt financial instrument;

4) the managing director of investment portfolio (further - UIP) - the professional participant of the security market performing on its own behalf, in interests and at the expense of pension assets activities for management of investment portfolio based on the license according to the Law of the Republic of Kazakhstan "About the security market", and also conforming to requirements of authorized body for implementation of trust management of pension assets;

5) current value of the financial instrument - the cost of the financial instrument reflected in financial accounting, including principal debt, the added remuneration, unamortized award (discount), positive (negative) value adjustment, reserves (provisions);

6) fair value of the financial instrument - the cost determined according to Items 4, of 5, of 6, of 7, of 8, of 9, of 10, of 11, of 12, of 13, of 27, of 30, of 31, of 32, of 33, of 34, of 35, of 37, of 38, of 39, of 40 and 42 Rules;

7) structural notes - the financial instruments issued by nonresident issuers of the Republic of Kazakhstan whose conditions of release provide dependence of payments of the amounts of principal debt and (or) remuneration on these financial instruments from achievement of the indicators set in the conditions of their release;
