About measures for the effective organization of public administration in the sphere of water economy within administrative reforms

For the purpose of ensuring execution of the Presidential decree of the Republic of Uzbekistan of January 25, 2023 No. UP-14 "About First-priority Organizational Measures for Effective Establishing Activities of Republican Executive Bodies":

1. Approve:

Priority activities of the Ministry of water economy according to appendix No. 1;

Organizational structure of the Ministry of water economy according to appendix No. 2;

"Road map" on deepening of reforms in the sphere of water economy and transformation of activities of system according to appendix No. 3.

2. Determine that in system of the Ministry of water economy:

a) central office of the Ministry:

develops single state policy in the sphere of water economy, renders methodical ensuring its realization and activities of executive bodies on places;

determines target indicators of assessment of activities of the territorial authorities of the executive authority entering its system and organizational subordination and also coordinates work on their achievement;

adopts departmental regulatory legal acts and develops drafts of regulatory legal acts within function of legal regulation;

coordinates holding actions for identification and the problem resolution in technical condition of water management objects, water supply and meliorative condition of lands in regions, within the powers - performs legal regulation and control functions;

develops and realizes system measures for completion of structural divisions by qualified personnel, continuous increase in their knowledge and skills;

creates worthy and fair conditions for implementation of labor activity and compensation;

considers appeals of physical persons and legal entities concerning the sphere of water economy, and also coordinates and generalizes activities of territorial subdivisions for establishing open dialogue with the population;

b) territorial subdivisions:

perform practical and address measures on realization of single state policy and achievement of the established target indicators in the sphere of water economy in the corresponding territory;

carry out the analysis of technical condition of water management objects, water supply, meliorative condition of lands in the territories and problems in the sphere, take part in development and program implementation of the solution of these problems and development of water economy;

take measures for ensuring timely and high-quality execution of acts of the legislation and orders on places;

consider appeals of physical persons and legal entities, within the powers - perform measures of the state control in the corresponding territory.

3. Provide to the minister of water economy within execution of the tasks assigned to it the right to involvement of highly qualified specialists of state bodies and other organizations, the research and educational organizations, and also the international organizations and the foreign companies as consultants.

4. To the ministry of water economy (B. Kamalov) and to the Ministry of Economics and finance (A. Karimov) together with Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas till the end of 2030 to provide step-by-step transfer to public-private partnership of such functions of local (district) link of the Ministry of water economy as water resources management, water supply to farms and other water users, and also water accounting.

At the same time till September, 2023:

develop conditions and the standard agreement of the transfer to public-private partnership of water resources management in areas;

determine specific mechanisms of stimulation of increase in appeal of project data;

develop measures for the translation of water resources management in all areas on public-private partnership.

5. Rename the State inspectorate for control of safety of objects of water economy under the Ministry of water economy into Inspectorate for control of safety of objects of water economy and water use under the Ministry of water economy (further - Inspection).

Approve organizational structure of Inspectorate for control of safety of objects of water economy and water use according to appendix No. 4.

6. Transfer to Inspection the following functions Inspectorates for control of agro-industrial complex under the Ministry of Agriculture:

control of rational water resources management, observance of rules (procedure) of water use and water consumption on all superficial water objects;

realization of package of measures for identification of offenses in the sphere of water economy, taking measures to elimination of the reasons and conditions generating them;

hearing of cases about administrative offenses in the sphere of water use on all superficial water objects.

For the purpose of effective realization of the functions determined by this Item to transfer Inspections of 159 established posts of Inspectorate for control of agro-industrial complex under the Ministry of Agriculture exercising control of water consumption on artificial water objects.

7. Agree with the offer of the Ministry of water economy, the Ministry of Economics and finance, Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas on creation of managements of Inspection in the Republic of Karakalpakstan and areas with the status of the legal entity.
