About approval of the Regulations on procedure for reference of objects of town-planning activities of special regulation to objects of nation-wide and local value and establishment of borders of objects of town-planning activities of special regulation

For the purpose of strengthening and enhancement of normative basis of town-planning activities in the republic, rational use of the territory, protection of natural wealth, ensuring interests of society and the state, and according to article 7 of the Town-planning code of the Republic of Uzbekistan the Cabinet of Ministers decides:

1. Approve Regulations on procedure for reference of objects of town-planning activities of special regulation to objects of nation-wide and local value and establishment of borders of objects of town-planning activities of special regulation according to appendix.

2. To the state committee on architecture and construction, the Ministry of Emergency Situations, for culture and sport to provide health cares to the State committee on conservation, the Federation Council of labor unions of Uzbekistan, other interested ministries and departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent till July 1, 2007 to the Cabinet of Ministers of the offer on objects of town-planning activities, with indication of their borders, the Cabinet of Ministers which is subject to special regulation and determined.

3. Assign to the Ministry of construction of the Republic of Uzbekistan:

development of special rules of use and building of subjects to special town-planning regulation with the assistance of the interested ministries (departments);

implementation of coordination and conducting monitoring of activities of the ministries and departments of reference of objects of town-planning activities of special regulation to objects of nation-wide and local value and establishment of borders of objects of town-planning activities of special regulation.

4. To provide to the ministries, departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent strict observance of the specified Provision.

5. To impose control over the implementation of this resolution on the Deputy prime minister of the Republic of Uzbekistan Hanov N. M.

Regulations on procedure for reference of objects of town-planning activities of special regulation to objects of nation-wide and local value and establishment of borders of objects of town-planning activities of special regulation

I. General provisions

1. This Provision is developed according to the Town-planning code of the Republic of Uzbekistan and other acts of the legislation of the Republic of Uzbekistan and determines procedure:

references of objects of town-planning activities of special regulation to objects of nation-wide and local value;

establishments of borders of objects of town-planning activities of special regulation.

2. Reference of objects of town-planning activities to objects of town-planning activities of special regulation is performed for the purpose of introduction in the territories of these subjects of special rules without which use of these territories, taking into account ensuring interests of society, the state, legal entities and physical persons in the field of town planning is impossible or complicated.

3. Town-planning activities are subject to special regulation on:

territories subject to impact of emergency situations of natural and technogenic nature;

the territories contaminated by chemical and (or) biological substances, harmful microorganisms over threshold limit values, radioactive materials over maximum permissible levels;

the protected natural territories.

Town-planning activities can also are subject to special regulation on:

territories of the city of Tashkent;

territories of the city of Nukus;

the territories of the cities which are the administrative centers of areas;

the territories of the cities having objects of cultural heritage;

territories of resort towns;

territories of the cities reserves;

the territories of settlements with specific mode of life activity (military camps, other regime territories, settlements in national parks and other protected natural territories).

4. Reference of objects of town-planning activities to category especially regulated and establishment of their borders are performed by the relevant state bodies according to the procedure, provided by this Provision. At the same time:

the materials on reference of objects of town-planning activities of special regulation to objects of nation-wide and local value directed for review to the republican ministries (departments) are considered in two-month time;

the materials on establishment of borders of objects of town-planning activities of special regulation of nation-wide and local value directed for review to the republican ministries (departments), other interested organizations, are considered in a month.

5. Terms of introduction of special regulation in the territories and objects of town-planning activities, and also in settlements are established by public authorities of the Republic of Uzbekistan on representation of the interested ministries, departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent.

6. Town-planning activities during special regulation in the territories of objects are performed according to special town-planning regulations and rules, special procedure for development and approval of town-planning documentation and issue of special construction permits of objects.

II. Reference of objects of town-planning activities of special regulation to objects of nation-wide value

7. Reference of the objects of town-planning activities of special regulation located in the territories subject to impact of emergency situations of natural and technogenic nature to objects of nation-wide value is performed by the Cabinet of Ministers of the Republic of Uzbekistan on the representation of the Ministry of Emergency Situations based on data of the interested ministries, departments, Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent.

8. Reference of the objects of town-planning activities of special regulation located in the territories contaminated by chemical and (or) biological substances, harmful microorganisms over threshold limit values, radioactive materials over maximum permissible levels to objects of nation-wide value is performed by the Cabinet of Ministers of the Republic of Uzbekistan on representation of the Ministry of Emergency Situations and State committee on conservation.
