About the Procedure for forming of the state social housing stock

1. Approve the Procedure for forming of the state social housing stock it (is applied).

2. To provide to the ministries and departments, local executive bodies of the government and self-government institutions of settlements and dekhot execution of this Procedure.

Procedure for forming of the state social housing stock

1. The procedure for forming of the state social housing stock (further - the Procedure) determines process of forming of the state social housing stock of use.

2. The state housing stock of social use is created for the purpose of providing the needing citizens with premises.

3. The authorized state body in the housing sphere together with the ministries, departments, local executive bodies of the government and self-government institutions of settlements and dekhot within the republican, local budgetary funds and other sources of financing which are not forbidden by the legislation of the Republic of Tajikistan creates the state housing stock of social use.

4. The ministries and departments, local executive bodies of the government, self-government institutions of settlements and dekhot for forming of the state housing stock of social use represent the list of the premises which are available on their balance to authorized state body in the housing sphere.

5. Main sources of forming of the state housing stock of social use:

1) the premises built at the expense of means of municipal and (or) republican, private commercial, non-profit organizations and donations;

2) private premises, based on the agreement, transferred to local executive body of the government to use as social housing;

3) the premises which passed from other housing stocks into this fund on the basis of requirements of the legislation;

4) reconstruction of the state room of social use;

5) re-equipment of non-residential buildings to the state room of social use;

6) the premises donated this fund from physical, legal entities and the public international organizations;

7) the premises withdrawn based on court resolution or recognized in the procedure established by the legislation ownerless and contributed to this fund;

8) the premises which passed into this fund according to the transaction.

6. Premises from the state housing stock of social use are provided to citizens under the agreement of social hiring for temporary use and shall conform to sanitary requirements.

7. For the purpose of stable forming and protection of the state housing stock of social use, transfer of premises from the state housing stock of social use in other housing stocks is forbidden if other procedure is not provided in the legislation of the Republic of Tajikistan.
