About approval of the Regulations on presentation of requirements and application of corrective actions by the National Bank of Ukraine to objects of oversight of payment infrastructure

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", Articles 82, 84 Laws of Ukraine "About payment services", for the purpose of establishment of procedure for presentation of requirements and application of measures of influence by the National Bank of Ukraine to objects of oversight of payment infrastructure the Board of the National Bank of Ukraine decides:

1. Approve Regulations on presentation of requirements and application of corrective actions by the National Bank of Ukraine to objects of oversight of payment infrastructure which is applied.

2. Recognize invalid:

1) the resolution of Board of the National Bank of Ukraine of December 19, 2013 No. 524 "About approval of the Regulations on application of corrective actions by the National Bank of Ukraine for violation by objects of supervision (oversight) of the legislation of Ukraine concerning activities of payment systems in Ukraine", registered in the Ministry of Justice of Ukraine on January 15, 2014 at No. 62/24839;

2) the resolution of Board of the National Bank of Ukraine of November 25, 2015 No. 815 "About modification of some regulatory legal acts of the National Bank of Ukraine";

3) the resolution of Board of the National Bank of Ukraine of January 25, 2016 No. 30 "About modification of the Regulations on application of corrective actions by the National Bank of Ukraine for violation by objects of supervision (oversight) of the legislation of Ukraine concerning activities of payment systems in Ukraine";

4) the resolution of Board of the National Bank of Ukraine of February 13, 2017 No. 11 "About approval of Changes in some regulatory legal acts of the National Bank of Ukraine";

5) the resolution of Board of the National Bank of Ukraine of June 07, 2018 No. 61 "About approval of changes in some regulatory legal acts of the National Bank of Ukraine";

6) the resolution of Board of the National Bank of Ukraine of November 22, 2019 No. 140 "About approval of Changes in Regulations on application of corrective actions by the National Bank of Ukraine for violation by objects of supervision (oversight) of the legislation of Ukraine concerning activities of payment systems in Ukraine".

3. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Alexey Shaban.

4. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on presentation of requirements and application of corrective actions by the National Bank of Ukraine to objects of oversight of payment infrastructure

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About payment services" (further - the Law), regulatory legal acts of the National Bank of Ukraine (further - National Bank).

2. This Provision establishes procedure for presentation by National Bank of requirements to objects of oversight of payment infrastructure (further - oversight) on elimination of violations of requirements of the legislation of Ukraine regulating activities of payment systems, use of payment schemes, transactions with payment instruments, electronic money (further - the legislation of Ukraine) both procedure and criteria of application of the corrective actions to them for violation of the law of Ukraine determined by article 84 of the Law.

3. Requirements of this provision extend to oversight objects which treat:

1) operators of payment systems (residents and nonresidents), clearing banks, technological operators of payment services, members of payment service providers regarding observance of the legislation of Ukraine regulating activities of payment systems, provision of services of payment services by technological operators by them (further - the technological operator);
