About approval of the Procedure for carrying out audit of fire and technogenic safety

According to part two of article 46-1 of the Code of civil protection of Ukraine the Cabinet of Ministers of Ukraine decides:

Approve the enclosed Procedure for carrying out audit of fire and technogenic safety.

Procedure for carrying out audit of fire and technogenic safety

1. This Procedure determines the mechanism of the organization and carrying out audit of fire and technogenic safety (further - audit).

Audit consists in the analysis of condition of activities of the subject of managing or other legal entity concerning compliance to requirements of the legislation in the sphere of fire and technogenic safety of houses, constructions, including construction objects, their complexes and/or parts of any appointment and pattern of ownership, the territories, systems (means) of fire-proof protection, the automated systems of early identification of threat of emergence of emergency situations and the notification of the population and other systems which are not their part, but are functionally connected with them, external (internal) fire-water supply, fire protection and lightning protection (further - object of audit).

2. In this Procedure terms are used in the value given in the Code of civil protection of Ukraine, the Laws of Ukraine "On regulation of town-planning activities" and "About architectural activities".

3. The main objectives of audit are:

1) carrying out analysis:

compliance to requirements of the legislation of organizational and administrative, project and technical documents concerning fire and technogenic safety;

qualities of personnel training (workers) to rules of fire and technogenic safety;

implementation of other actions provided by the Code of civil protection of Ukraine, other regulatory legal acts and regulating documents concerning fire and technogenic safety;

2) carrying out survey (inspection) object of audit concerning its compliance to requirements of regulatory legal acts and regulating documents in the sphere of fire and technogenic safety.

4. Audit is booked by the organizations irrespective of pattern of ownership which are entered in the corresponding register determined by the law (further - the organization booking audit).

The organization booking audit shall have the certificate about accreditation of the National agency on accreditation according to requirements of the DSTU ENISO/IEC 17020:2019 standard (ENISO/IEC 17020:2012, IDT; IDT ISO/IEC 17020:2012,) assessment of conformity. Job requirements of various types of bodies for inspection (regarding work in the sphere of fire and technogenic safety).

For carrying out audit by the organizations booking audit the experts in the sphere of fire and technogenic safety (further - experts) who passed professional certification and entered in the corresponding register determined by the law are attracted (including according to civil agreements).

5. The organization booking audit is determined by the subject of managing or other legal entity concerning whom audit is booked (further - the subject of audit).

Audit is booked according to the civil agreement signed between the organization booking audit and the subject of audit or person authorized by it according to requirements of the legislation for the address of the subject of audit (further - the address).

The address moves in the organization booking audit, personally by sending the mailing or electronically in the procedure established by the legislation.

The civil agreement on carrying out audit shall not contain provisions which realization can affect quality and result of audit, including the result shall not depend on payment terms the subject of audit.

6. The address shall contain the name and contact information of the subject of audit, the address of the actual location and the characteristic of object of audit - risk degree from implementation of economic activity in the sphere of technogenic and fire safety of the subject of audit and class of consequences (responsibility).

In the address information on availability on object of audit of systems (means) of fire-proof protection, external (internal) water supply, the automated systems of early identification of threat of emergence of emergency situations and the notification of the population in addition is specified.

The term of consideration by the organization booking audit addresses cannot exceed five working days from the date of its registration. By results of consideration of the address the organization booking audit reports to the subject of audit or person authorized by it about possibility (impossibility) of carrying out audit by sending the mailing or electronically in the procedure established by the legislation.

7. Audit is booked no later than 45 days after receipt of the corresponding address of the subject of audit or person authorized by it to the organization booking audit according to the legislation. The term of carrying out audit cannot exceed 10 working days.

8. Audit consists of the following stages:

1) preparatory, including:

acquaintance with activities of the subject of audit for ensuring fire and technogenic safety on object of audit;

preliminary studying of object of audit, including its space-planning and constructive decisions, characteristics (total area, the number of floors, availability of attics, underground and basements, quantity of workplaces and visitors, class of consequences (responsibility), fire resistance degree, risk degree from implementation of economic activity in the sphere of technogenic and fire safety of the subject of audit, system (means) of fire-proof protection, the automated systems of early identification of threat of emergence of emergency situations and the notification of the population and other systems which are not their part, but are functionally connected with them, external (internal) fire-water supply, fire protection of designs and lightning protection);

carrying out the analysis of the project and technical documentation which is available for the subject of audit, organizational and administrative and other documents concerning fire and technogenic safety;

scheduling of carrying out audit which shall include step-by-step actions with their detailed description, term of carrying out and necessary resources which affirms the head of the organization booking audit and agrees with the subject of audit or person authorized by it;

2) the basic including:

polls and interviews with personnel (employees);

consideration of organizational and administrative, project and technical documents concerning fire and technogenic safety;

inspection (survey) of object of audit, including using means of the measuring machinery and equipment;
