In pursuance of Item 6 (paragraph 2) resolutions of the Cabinet of Ministers of Ukraine of 25.08.98 N1340 "About the Accounting Treatment, Storages, Estimates of the Seized and Other Property Which Carries Over the State, and the Order It" of PRIKAZYVAYU:

1. Approve the Procedure for the order by currency values (except securities), precious metals and gemstones, gemstones of organogenic education and semiprecious stones which carry over the state (further the Procedure) that is applied.

2. Take into consideration that noted Procedure affirms also the resolution of Board of the National Bank of Ukraine.

3. Consider invalid the order of the Ministry of Finance of Ukraine and the National Bank of Ukraine of 18.12.95 of N202/122.

4. Control of observance of requirements of the Procedure is imposed on the First Deputy Minister of Finance P.K.Germanchuk.

This Procedure establishes single rules of accounting, storage and order by currency values (except securities), precious metals and gemstones, gemstones of organogenic education and semiprecious stones which carry over the state. It is developed according to the resolution of the Cabinet of Ministers of Ukraine of August 25, 1998 N1340 "About the Accounting Treatment, Storages, Estimates of the Seized and Other Property Which Carries Over the State, and the Order It", taking into account requirements of the Decree of the Cabinet of Ministers of Ukraine of 19.02.93 of N15-93 "About System of Currency Control and Currency Exchange Control" and the Law of Ukraine of November 18, 1997 N637/97-BP "About State Regulation of Production, Production and Use of Precious Metals and Gemstones and Control on Transactions with Them".

1. Procedure for the order currency values (except securities) which carry over the state

1.1. Action of this Procedure extends on:

a) currency of Ukraine and foreign currency, payment documents in currency of Ukraine and foreign currency (checks, bank payment cards) confiscated based on the judgment in cases, the amount and procedure established by the law;

b) the currency of Ukraine and foreign currency recognized ownerless according to the current legislation;

c) currency of Ukraine and foreign currency, payment documents in currency of Ukraine and foreign currency accepted on storage by customs authorities when the owner did not address for them in the time established by the Customs code;

d) currency Ukraine and foreign currency, payment documents in currency of Ukraine and foreign currency lost or left in hotels, transport, theaters, other public places (daleenakhodka) if their owner during the term established by the current legislation did not address for them;

?) currency values (except securities) in the form of treasure;

e) currency of Ukraine and foreign currency, and also payment documents in currency of Ukraine and foreign currency that by the right of inheritance the states carried over;

e) the currency of Ukraine and foreign currency presented to the state by the owner;

є) not handed international and account transfers after the termination of term of their storage by telecommunications agencies, determined by the current legislation, in case of impossibility of issue to their receiver and return to senders;

g) foreign currency and payment documents in foreign currency which are sent in the international mailings with violation of regulations of Universal Postal Union and regulations of the current legislation of Ukraine.

1.2. Accounting, storage and use of the withdrawn currency values

1.2.1. The currency of Ukraine, foreign currency of all groups on the Qualifier of foreign currencies of the National Bank of Ukraine (daleeklassifikator) withdrawn from legal entities and physical persons by law enforcement, tax and customs authorities for violation of the current legislation before adoption of the judgment or other decision on transition of currency values according to the current legislation in property of the state, accepted by customs authorities on storage in the cases provided by the current legislation, found by any bodies as ownerless, finds, heritable, presented to the state in five-day time is collected by the relevant services which are engaged in transportation of currency values in authorized banks. I.e. in the National export-import bank (Ukreksimbank), Joint-stock and commercial agro-industrial bank "Ukraine", Joint-stock commercial bank of social development Ukrsotsbank, the Ukrainian joint industrial investment bank "Prominvestbank", the National specialized commercial savings bank, Joint post and pension stock bank "Aval" with which the Head department of the State Treasury signs Service agreements of the Government budget.

The list of authorized banks can be added according to the decision of the Cabinet of Ministers of Ukraine and the National Bank of Ukraine

1.2.2. Authorized banks accept noted money based on the letter, the description of values with instructions of the name and nominal, numbers of the banknotes and documents confirming the withdrawal fact and not later than the following banking day:
