About approval of Rules of certification of social workers in the sphere of social protection of the population

According to the paragraph the thirty second subitem 5) article 12 of the Social code of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve the enclosed Rules of certification of social workers in the sphere of social protection of the population according to appendix 1 to this order.

2. Recognize invalid some orders of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to social services department in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) official publication and placement of this order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

5. This order becomes effective since July 1, 2023 and is subject to official publication.

Rules of certification of social workers

Chapter 1. General provisions

1. These rules of certification of social workers (further - Rules) are developed according to the paragraph the thirty second the subitem 5) of article 12 of the Social code of the Republic of Kazakhstan and determine procedure for certification of the social workers rendering special social services in the organizations irrespective of pattern of ownership and departmental subordination.

2. In these rules the following terms and determinations are applied:

1) certification - the procedure which is carried out for the purpose of determination of skill level of the social worker by results of which qualification categories are appropriated;

2) the social worker - the worker who is rendering special social services and (or) performing assessment and determination of need for special social services, having the necessary qualification conforming to the established requirements;

3) qualification category - the level of requirements to qualification of the worker reflecting complexity of performance of works;

4) authorized state body - the central executive body performing management and cross-industry coordination in the sphere of social protection of the population according to the legislation of the Republic of Kazakhstan;

5) authorized body - authorized bodies of the respective sphere of areas, cities of republican value, the capital.

3. Social workers undergo certification at least once in three years, but not earlier than one year from the date of the occupation of this position, at the same time the social worker who is on child care leave is certified not earlier than in six months after appearance at work.

Qualification categories are appropriated to social workers for a period of three years.

4. Certification includes:

1) interviewing;

2) pronouncement of the legal solution of certifying commission.

Chapter 2. Procedure for certification of social workers

Paragraph 1. Organization of work on carrying out certification

5. For carrying out certification authorized bodies create certifying commission from at least five members and the secretary.

The chairman is elected members of certifying commission from their number.

6. The meeting of certifying commission is considered competent if at it there were at least two thirds of its structure.

The decision of certifying commission is made by open voting by a majority vote of members of certifying commission. In case of equality of votes the voice of the chairman of certifying commission is decisive.

7. In case of appearance on certification the social worker shows the document on recognition of professional qualification according to Item 1 of article 21 of the Law of the Republic of Kazakhstan "About professional qualifications" and the document proving his identity, or the digital identity certificate from service of digital documents (for identification).

The certifying commission before passing of certification informs the social worker on procedure for carrying out certification and their duration.

In case of absence of the social worker on meeting of certifying commission on reasonable excuse, consideration of question of its certification is transferred to term no later than one month from the date of its appearance at work.

8. For assignment (confirmation) of qualification category the social worker submits the following documents to authorized body:

the written application in any form;

personal leaf on registration of personnel;

the copy of the diploma about education certified by personnel service of the organization;

the copy of the service record certified by personnel service of the organization;

copy of the certificate on assignment of qualification category (in the presence);
