About national registers of identification numbers

This Law determines the purposes, tasks, the principles and the legal basis of creation and maintaining national registers of identification numbers on the basis of forming for the physical, legal entity (branch and representation) of identification number.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

1. In this Law the following basic concepts are used:

1) the control category - the digital symbol completing the sequence of the digital symbols constituting the individual identification number intended for control of correctness of its forming;

1-1) business and identification numbers - the unique number created for the legal entity (branch and representation) and the individual entrepreneur performing activities in the form of joint venture;

2) the National register of business and identification numbers - the state database intended for accounting and storage of information about the legal entities (branches and representations), individual entrepreneurs performing activities in the form of joint venture, forming and storage of data on the assigned business and identification numbers created and stopped activities in the territory of the Republic of Kazakhstan;

3) individual identification number - the unique number created for physical person, including the individual entrepreneur performing activities in the form of personal entrepreneurship;

4) the National register of individual identification numbers - the state database intended for forming, accounting, storage of information on individual identification numbers and the information about physical persons to which they are appropriated;

5) authorized state body (further - authorized body) - the state body performing forming of identification numbers and maintaining national registers of identification numbers;

6) identification number - the individual identification number or business and identification number expressed as the sequence of the digital symbols allowing to make records about data, relating to certain person in national registers of identification numbers;

7) the document with identification number - the document issued by registering body, confirming availability of identification number;

8) forming of identification number - process as a result of which the authorized body forms identification number in national registers of identification numbers based on data on physical persons and legal entities (branches and representations);

9) national registers of identification numbers - the information systems intended for implementation of registration accounting of individual and business and identification numbers;

10) registering bodies - the state bodies and The Government for Citizens State corporation performing registration of data and issue of documents with identification number.

2. The special concepts of the legislation of the Republic of Kazakhstan on national registers of identification numbers which are not specified in this Article are used in the values determined in the relevant articles of this Law.

3. Official reducing when specifying identification numbers on documents is recognized:

1) IIN - for individual identification number;

2) the BIN - for business and identification number.

Article 2. Legislation of the Republic of Kazakhstan on national registers of identification numbers

1. The legislation of the Republic of Kazakhstan on national registers of identification numbers is based on the Constitution of the Republic of Kazakhstan and consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.

2. If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which are provided in this Law then are applied rules of the international treaty.

Article 3. Purpose and tasks of creation, maintaining national registers of identification numbers and forming of identification number

1. The purpose of creation and maintaining national registers of identification numbers is transition to single system of registration of the data relating to certain person on the basis of introduction in the Republic of Kazakhstan of identification number.

2. Tasks of creation and maintaining national registers of identification numbers are:

1) updating of information databases of state bodies and exception of duplication of information;

2) enhancement of the controling mechanism and use of electronic information resources;

3) enhancement of relations of physical persons and legal entities with state bodies by means of acceleration and simplification of procedures in case of their addresses.

3. Forming of identification number for physical person or legal entity (branch and representation) is performed for preserving the data relating to certain physical person or legal entity (branch and representation) in national registers of identification numbers and information systems of state bodies and other public institutions.

4. Identification number is applied in case of:

1) civil registrations;

2) to issue of identity documents;

3) state registration of objects of real, personal estate, and also other objects equated to immovable things;

4) implementation of payments and money transfers, including in case of transfer of compulsory pension contributions and social assignments, assignments and (or) fees to compulsory social medical insurance, and also execution of the tax liabilities, except for implementation of payments and money transfers by foreigners and stateless persons;
