About informatization

This Law establishes the legal basis of informatization, governs the public relations arising during creation, use and protection of electronic information resources and information systems.

Chapter 1. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

1) automation – application of information and communication technologies for processing, systematization, storage and information transfer for the purpose of simplification and replacement of forms of human labor, performance improvement and transparency of processes;

1-1) informatizations – the organizational, social and economic and scientific and technical process directed to forming and development of electronic information resources, information systems on the basis of use of information technologies;

2) authorized body in the field of informatization (further - authorized body) - the central state body performing management in the field of informatization and "the electronic government";

3) No. 34-V ZRK is excluded according to the Law of the Republic of Kazakhstan of 10.07.2012

4) the operator in the field of informatization - the legal entity created according to the decision of the Government of the Republic of Kazakhstan to which tasks on integration of the state information systems and state electronic information resources, on participation in realization of single technical policy in the field of informatization, function of the project integrator of infrastructure of "the electronic government" are assigned;

5) information works - activities for creation of electronic information resources and information systems;

6) information system - the system intended for storage, processing, search, distribution, transfer and provision of information using the hardware and software;

7) deposition of information systems, software products, program codes and the specifications and technical documentation (further - deposition) - transfer of copies of software products, program codes and the specifications and technical documentation on storage in depositary;

8) audit of information systems - system process of assessment of current status of information system, the actions and events which are taking place in it, the establishing level of their compliance to certain criteria, technical regulations, standards, the specifications and technical documentation and (or) requirements of the customer;

9) depositary of information systems, software products, program codes and the specifications and technical documentation (further - depositary) - the special storage intended for ensuring accumulating, the description, storage and systematization of copies of software products, program codes together with the specifications and technical documentation accompanying them;

10) information communication network - set technical and the hardware and software of ensuring interaction between information systems or between their components, and also transfers of information resources;

10-1) monitoring system of information communication networks - complex of the organizational and technical actions directed to rendering assistance to owners, owners and users of information systems, information communication networks and electronic information resources concerning safe use of information and communication technologies including response to computer incidents;

11) information service - service in provision to users of information resources;

12) information processes - processes of creation, collection, processing, accumulating, storage, search, distribution and consumption of information;

13) information technologies - set of the methods, production processes and program technical means united in the technological complex providing collection, creation, storage, accumulating, processing, search, output, copying, transfer and distribution of information;

14) the hardware and software - set of the program and technical means providing information processes;

15) public key infrastructure - the complex of information systems, organizational and technical actions directed to management of registration certificates according to the legislation of the Republic of Kazakhstan on the electronic document and the electronic digital signature;

16) software product - set of computer programs, procedures, techniques, rules and the accompanying documentation of information handling system;

18) domain name - the character (alphanumeric) designation created according to rules of addressing of the Internet, intended for the named appeal to object of network and corresponding to certain network address;

19) interactive service - service in provision of electronic information resources to users on their requests or by agreement of the parties, requiring mutual information exchange;

20) Internet resource - the electronic information resource, technology of its maintaining and (or) use functioning in open information communication network and also the organizational structure providing information exchange;

21) the owner of Internet resource - the subject in full exercising rights of possession, uses and orders of Internet resource;

22) computer incident - separately or serially arising failures in work of information systems, information resources, information communication networks creating threat to their proper functioning and (or) conditions for illegal obtaining, copying, distribution, misstatement, modification, destruction or blocking of information addressing in them;

23) the Interdepartmental commission of the Republic of Kazakhstan on coordination of works in the field of informatization - the advisory advisory body under the Government of the Republic of Kazakhstan performing coordination of works in the field of forming of "the electronic government" and informatization of state bodies;

24) documentary information - the information fixed on the material carrier, having the details allowing to identify it;

25) confidential electronic information resources - the electronic information resources which are not containing the state secrets, access to which is limited according to the laws of the Republic of Kazakhstan or their owner or the owner in cases, stipulated by the legislation the Republic of Kazakhstan;

26) information system "Address register" the hardware and software intended for creation, accumulating, processing of data on addresses and their components and unification of address field of the Republic of Kazakhstan;

27) the single transport circle of state bodies - the network of telecommunications located in the territory of the Republic of Kazakhstan, consisting of interdepartmental information communication network, intended for realization of managerial and organizational goals and interaction among themselves of local government bodies, state bodies, including their territorial subdivisions and the subordinated organizations, and also intended for ensuring interaction of electronic information resources and information systems of "the electronic government";

28) the operator of the single transport circle of state bodies - the legal entity having the hardware and software of the single transport circle of state bodies and providing communication services to state bodies, territorial subdivisions and the subordinated organizations, determined by the Government of the Republic of Kazakhstan;

28-1) public technical service - the republican state company on the right of economic maintaining created according to the decision of the Government of the Republic of Kazakhstan;

29) the user - the subject addressing information system for receipt of electronic information resources necessary for it and using them;

30) transactional service - the service in provision to users of electronic information resources requiring mutual information exchange using the electronic digital signature;
