1. Approve the enclosed Rules and operating conditions of paid highways and bridge crossings.

2. Bring in the order of the Government of the Republic of Kazakhstan of September 5, 1998 No. 845 "About enhancement of legal support of road economy" (SAPP of the Republic of Kazakhstan, 1998, No. 31, the Art. 269) the following change:

Rules and operating conditions of paid highways and bridge crossings

1. General provisions

1. These rules and operating conditions of paid highways and bridge crossings (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About highways" (further - the Law) and determine procedure and operating conditions of paid highways (sites) and bridge crossings of the Republic of Kazakhstan transferred to the National operator on management of highways or the concessionary.

2. In these rules the concepts provided by the Law and the following concepts are used:

1) users highways - physical persons and legal entities, being participants of traffic or performing other activities within right of way of highways and roadside strip;

2) operation of paid highways (sites) and bridge crossings - implementation of actions for ensuring continuous, safe motion of vehicles on paid highways (sites) and bridge crossings with the established loadings, dimensions and maintenance of their transport and operational condition in operation period;

3) organizer of paid movement - The national operator on management of highways or the concessionary;

4) the bridge crossing - the complex of engineering constructions for overcoming water obstacle including the bridge, approaches to the bridge, regulatory and protective constructions.

2. Procedure and operating conditions of paid highways (sites) and bridge crossings

3. Operation of paid highways (sites) and bridge crossings provides timely ensuring with the organizer paid movement of actions for their repair and content according to the legislation of the Republic of Kazakhstan.

4. The organizer of paid movement for the purpose of proper operation of paid highways (sites) and bridge crossings:

1) is provided by observance of safety requirements in case of operation of highways according to the legislation of the Republic of Kazakhstan;

2) provides cleaning of paid highways (sites) and bridge crossings of snow during the winter period and takes measures against slipperiness of covering;

3) is provided by uninterrupted and safe journey of vehicles and observance of requirements of the nature protection legislation;

4) takes measures for damages to users highways according to legal acts of the Republic of Kazakhstan, caused by the road accidents, arisen because of road conditions;

5) is provided by phytosanitary condition of right of way of highways according to legal acts of the Republic of Kazakhstan;

6) contains protective plantings along highways;

7) in coordination with road authorities, together with divisions of road traffic police and authorized body on emergency situations limits or closes movement of vehicles in extreme conditions (adverse weather climatic conditions, natural disasters, the fire, loss of bearing capacity of highways), and also when carrying out repair construction works with the notification on it of local actuators and users by highways, establishment of the corresponding route signs and through mass media;

8) eliminates effects of the spontaneous meteorological phenomena and emergency situations of natural and technogenic nature;

Records 9) in case of interaction with divisions of road traffic police the road accidents, analyzes the reasons and conditions promoting their origin, develops actions for their prevention and liquidation;

10) is provided by possibility of safe journey of vehicles within the high-speed mode set by the Traffic regulations of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of November 25, 1997 No. 1650;

11) takes measures for rescuing of participants of traffic, rendering pre-medical medical care to them in cases of the road accidents, accidents, natural disasters;

12) renders assistance to divisions of road traffic police in investigation of the road accidents, and also makes office investigation if the road accident happened on the accompanying road conditions;

13) renders assistance to the bodies performing operational search activities according to the legislation of the Republic of Kazakhstan;

14) is provided by the device and repair of technical means of the organization of traffic (barriers, signs, marking, guiding devices, networks of lighting, traffic lights, systems of automated management of movement);

15) is provided by the device of gages, the equipment and the software for monitoring of movement of vehicles with connection to necessary information and communication networks;

16) is provided by collection of fare on paid highways (sites) according to the legislation of the Republic of Kazakhstan.

5. Works on content of paid highways (sites) and bridge crossings are performed on permanent basis.

6. For the purpose of timely work on content of paid highways (sites) and bridge crossings their visual survey is performed daily.

7. Control of operation of paid highways (sites) and bridge crossings performs authorized state body on highways.
