RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About approval of procedure for introduction of the obligatory automated control systems of emissions of pollutants

According to part two of article 32 of the Law of Ukraine "About protection of atmospheric air" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for introduction of the obligatory automated control systems of emissions of pollutants which is applied.

2. This resolution becomes effective from the date of its publication and is effective from the date of the termination or cancellation of warlike situation in Ukraine.

Procedure for introduction of the obligatory automated control systems of emissions of pollutants

1. This Procedure determines the mechanism of introduction of the obligatory automated control systems behind amount and parameters of emissions of the pollutants which are thrown out in atmospheric air by organized stationary sources (further - the automated control system of emissions).

2. In this procedure the term "the automated control system of emissions" is used in value of the information and measuring system consisting of measuring instruments, other devices and intended for continuous measurement of parameters of the leaving gases and content in them of pollutants, and also for calculation of amount of emissions and data transmission of the automated tool measurements in the Ministry of Ecology and Natural Resources.

Other terms are used in the value given in the Laws of Ukraine "About protection of atmospheric air" and "About metrology and metrological activities".

3. Implementation of the automated control system of emissions is performed on purpose:

receipts of reliable and operational information about content of pollutants in emissions from stationary sources;

control of observance of the amount of emissions approved by permission to emissions of pollutants in atmospheric air by stationary sources;

accounting of emissions for creation and submission of the reporting, including tax and the reporting connected with the international obligations of Ukraine;

efficiency evaluations of the actions directed to reduction of amount of emissions of pollutants and also overall performance of the gas-purifying equipment.

Functioning of the automated control system of emissions is provided by application of the automated tool measurements of amounts and parameters of emissions of pollutants from stationary sources (further - the automated tool measurements).

Subjects of managing can also perform periodic tool and laboratory measurements of parameters of emissions of pollutants from stationary sources and overall performance of the gas-purifying equipment.

4. The automated tool measurements are taken by subjects of managing in case:

operation of production or processing equipment on the new created stationary source according to the list of productions and processing equipment on which the automated tool measurements of parameters of emissions of pollutants, according to appendix are taken;

business necessity on own initiative the subject of managing by decision path about carrying out such measurements on the substances and indicators determined by it what the specified subject notifies the Ministry of Ecology and Natural Resources by the letter from the date of adoption of such decision in a month on.

5. The automated tool measurements include such parameters as temperature, pressure, content of water vapor in the leaving gases.

Measurement of content of water vapor in waste gases are not carried out if the selected tests of waste gas were dried to the analysis of emissions.

On installations of burning of waste and installations of compatible burning of waste the automated tool measurements of temperature are taken near internal wall or in other representative point of the combustion chamber.

6. Determination of places of selection and sampling, the analysis of the corresponding pollutants and measurement of parameters of processes, and also quality assurance of the automated control system of emissions and reference methods of measurement for calibration and certification of the specified systems are performed according to the national standards establishing requirements to processes and parameters of operation of the automated control system of emissions. Account of national standards is kept by the Ministry of Ecology and Natural Resources and will promulgate them on the official website.

7. The automated tool measurements are taken with use of means of the measuring equipment which conform to requirements of the legislation On metrology and metrological activities.

8. Subjects of managing provide data transmission of the automated tool measurements in the Ministry of Ecology and Natural Resources according to technical requirements and specifications of data transmission in program technical means of the specified ministry.

9. Collection, processing and the analysis of transmitted data of the automated tool measurements are performed by the Ministry of Ecology and Natural Resources by means of program technical means.

10. The term of installation of the automated control system of emissions and ensuring data transmission of the automated tool measurements:

constitutes no more than five years from coming into force of this resolution for the subjects of managing specified in the paragraph the second item 4 of this Procedure;

it is established by subjects of managing which are specified in paragraph three of item 4 of this Procedure.
