About creation in cooperation with Asian Development Bank in the city of Tashkent and the Tashkent region of high comprehensive schools on the basis of public-private partnership

For the purpose of construction in the city of Tashkent and the Tashkent region on the basis of public-private partnership of the high comprehensive schools conforming to international standards, ensuring their maintenance at the high level and also creation of necessary conditions for receipt of quality education by pupils:

1. Take into consideration that:

Asian Development Bank (further - ABR), the Ministry of preschool and school education, the Ministry of Economics and finance, and also the Ministry of investments, industry and trade on December 17, 2019 signed the Agreement on consultations and maintenance (further - the Agreement);

according to the Agreement the agreement on realization in 2023-2024 with participation of ABR of the "Creation of 13 High Comprehensive Schools in the City of Tashkent and the Tashkent Region on the basis of Public-private Partnership" project is reached (further - the Project).

2. Determine that within the Project the following form of public-private partnership takes root:

a) by the project of the organization of high comprehensive schools on the basis of public-private partnership the state partner determines the Ministry of preschool and school education;

b) the private partner is determined following the results of the international tender held according to the Law of the Republic of Uzbekistan "About public-private partnership" and the agreement on public-private partnership on construction, equipment and operation of high comprehensive schools, without the right of the further order is signed with it;

c) private partner:

carries out works on designing, construction and equipment of high comprehensive schools at the expense of own means and attraction of the credits;

transfers the constructed high comprehensive schools to use to the state partner;

during operation of the agreement on public-private partnership takes all necessary measures for content and operation of high comprehensive schools;

after completion of term of the agreement on public-private partnership transfers high comprehensive schools to the possession to the state partner;

d) state partner:

at the expense of the means of the Government budget and means provided by acts of the legislation will organize educational process at the high comprehensive schools transferred to it to use of the private partner;

makes payments to the private partner for free use of high comprehensive schools.

3. Determine that:

payments to the private partner for free use of high comprehensive schools become covered from the Government budget;

payments for free use in accordance with the terms of the agreement on public-private partnership are annually indexed on the mechanism based on exchange rate fluctuations of national currency to foreign currency.

To the Ministry of Economics and finance (Sh. Kudbiyev) when forming parameters of the Government budget annually, since year of project startup to provide payments for use of high comprehensive schools.

4. Approve:

The list of the parcels of land allocated to the Ministry of preschool and school education in the territory of the city of Tashkent and the Tashkent region with the right of permanent use for the purpose of project implementation "Creation of 13 high comprehensive schools in the city of Tashkent and the Tashkent region on the basis of public-private partnership" according to appendix No. 1;

Target indicators of the "Creation of 13 High Comprehensive Schools in the City of Tashkent and the Tashkent Region on the basis of Public-private Partnership" project according to appendix No. 2;

"Road map" on project implementation "Creation of 13 high comprehensive schools in the city of Tashkent and the Tashkent region on the basis of public-private partnership" according to appendix No. 3.

5. Agree with the offer of the Ministry of preschool and school education and khokimiyat of the Tashkent region on the translation of the lands of agricultural purpose specified in appendix No. 1 to this resolution, total area of 67,55 of hectare from which hectare 66,98 - the irrigated parcels of land, respectively in category of lands of settlements.

6. To khokimiyat of the city of Tashkent (Sh. Umurzakov) and to khokimiyat of the Tashkent region (Z. Mirzayev):

till August 1, 2023 to provide withdrawal in accordance with the established procedure for social needs of the parcels of land belonging to physical persons and legal entities and allocation to their Ministry of preschool and school education with the right of permanent use for project implementation;

for the purpose of prevention of reducing the parcels of land of agricultural purpose till June 1, 2024 to provide development of new lands by the square equal to the fivefold size of the area of the irrigated parcels of land which category changes according to this resolution.

7. Determine that:

in connection with allocation of the parcels of land for project implementation compensating payments on compensation of losses of agricultural and forestry and landscape production are not levied;

the parcels of land for project implementation are allocated to the Ministry of preschool and school education after total compensation of the damage to physical persons and legal entities caused in connection with their withdrawal for social needs, according to the procedure, established by acts of the legislation;

the new parcels of land of agricultural purpose are considered mastered after their registration by the Agency according to the inventory in accordance with the established procedure.

8. To the ministry of preschool and school education (H. Umarov):

provide return of part of the allocated parcels of land, remained unused after construction and commissioning of new high comprehensive schools according to the Project, in reserve of khokimiyats of the city of Tashkent and Tashkent region respectively;

together with the Ministry of Economics and finance (Sh. Kudbiyev) with involvement of foreign consultants to take measures for creation in other regions of the republic of high comprehensive schools on the basis of public-private partnership.

9. Determine that according to the Project:

for rendering to project participants technical services and development of the tender documentation from ABR funds in the amount of 1, of 1 million US dollars with return condition are allocated;

from allocated funds of ABR ABR the state partner at the expense of the Government budget, 950 thousand US dollars - private partners at the expense of own means returns to rendering technical services and development of the tender documentation of 150 thousand US dollars;

the expenses of the state partner connected with return of ABR of 150 thousand US dollars are compensated in the Government budget by the private partner after agreement signature about public-private partnership;
