According to article 56.1 of the Federal law "About Environmental Protection" Government of the Russian Federation decides:

1. Approve the enclosed Rules of determination of financial security of the legal entity, the individual entrepreneurs applying for acquisition of separate production facility, or the legal entity who is the legal successor of the reorganized legal person who belongs separate production facility.

2. Determine that the Ministry of Economic Development of the Russian Federation is the federal executive body authorized on receipt of the documents necessary for issue of the conclusion about financial security of the legal entity, the individual entrepreneur applying for acquisition of separate production facility, or the legal entity who is the legal successor of the reorganized legal person who belongs separate production facility, and on issue of such conclusion.

3. Determine that the Ministry of Economic Development of the Russian Federation is the federal executive body authorized on obtaining from the legal entity who is the legal successor of the reorganized legal person who belongs separate production facility, or the legal entity applying for acquisition of separate production facility, data on the transaction and documents in case, stipulated in Item the 11th article 56.1 of the Federal law "About Environmental Protection", and on the direction of the notification on such transaction in the Federal Tax Service and Federal Registration Service (its territorial authorities) according to the procedure, established by Rules of interdepartmental information exchange, including with use of single system of interdepartmental electronic interaction, by transfer of data on separate production facilities and also in case of the direction of the conclusions about compliance of the realized actions for prevention and liquidation of environmental pollution, including actions realized in case of preservation or liquidation of separate production facility, to the actions plan on prevention and liquidation of environmental pollution as a result of operation of separate production facility, the conclusions about financial security of the legal entity, the individual entrepreneur and notifications on the transaction, approved by the order of the Government of the Russian Federation of March 11, 2023 No. 377 "About approval of Rules of interdepartmental information exchange, including with use of single system of interdepartmental electronic interaction, by transfer of data on separate production facilities, and also in case of the direction of the conclusions about compliance of the realized actions for prevention and liquidation of environmental pollution, including actions, implemented in case of preservation or liquidation of separate production facility, to the actions plan on prevention and liquidation of environmental pollution as a result of operation of separate production facility, the conclusions about financial security of the legal entity, the individual entrepreneur and notifications on the transaction".

4. To the Ministry of Economic Development of the Russian Federation to approve:

the application form about issue of the conclusion about financial security of the legal entity, the individual entrepreneur, applying for acquisition of separate production facility, or the legal entity who is the legal successor of the reorganized legal person who belongs separate production facility;

form of the conclusion about financial security of the legal entity, the individual entrepreneur, applying for acquisition of separate production facility, or the legal entity who is the legal successor of the reorganized legal person who belongs separate production facility.

5. Realization of the powers provided by this resolution is performed within the number of workers of federal executive bodies, and also budgetary appropriations provided by it in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

6. This resolution becomes effective since September 1, 2023 and 6 years are effective.

1. These rules establish procedure for determination of financial security of the legal entity, individual entrepreneur, applying for acquisition of separate production facility, or the legal entity who is the legal successor of the reorganized legal person who belongs separate production facility (further - the applicant) in cases, stipulated in Item the 9th article 56.1 of the Federal law "About Environmental Protection".

2. In case of transaction on alienation of separate production facility or reorganization (except for reorganization in the form of transformation) the legal person who belongs separate production facility, more than in 5 years prior to the expiration of operation of buildings and constructions which are separate hazardous production facilities and (or) in which there are separate hazardous production facilities, and (or) useful life of subjects to placement of waste of I and II classes of danger or more than in 5 years prior to the expiration which is the earliest of the term of use of the subsoil plot or term of mining of minerals (in relation to coal mines), except as specified, stipulated in Item the 11th article 56.1 of the Federal law "About Environmental Protection", the applicant represents to the Ministry of Economic Development of the Russian Federation (further - authorized body) the statement for issue of the conclusion about financial security of the applicant (further respectively - the statement, the conclusion) in which data are specified and to which the documents provided by Items 3 and 4 of these rules are attached.
