About measures for implementation of system of certificates of "Green energy"

For the purpose of development of use of renewable energy resources based on the resolution of the President of the Republic of Uzbekistan of December 2, 2022 No. PP-436 "About measures for increase in efficiency of the reforms directed to transition of the Republic of Uzbekistan to "green" economy till 2030":

1. Approve the offer of the Ministry of Economics and finance, the Department of Energy and Uzbekgidroenergo Joint-stock company on step-by-step implementation of system of the certificates of "green energy" confirming power generation with use of renewable energy resources:

since July 1, 2023 - for the electric power developed on hydroelectric power stations of system of Uzbekgidroenergo joint-stock company;

since October 1, 2023 - for the electric power developed on solar, wind and hydroelectric power stations and also from other renewable energy resources.

2. Establish procedure according to which:

one certificate of "green energy" confirms development 1 000 kvt*chas to the electric power with use of renewable energy resources;

certificates of "green energy" can be transferred to other persons both together with sale by electrical energy, and irrespective of such sale;

registration of objects of generation, release of the certificates of "green energy" having unique identification number accounting of their movement are performed on the Single electronic platform of certificates of "green energy" on the basis of requirements of international standards;

on the relations connected with release, issue, repayment and the circulation of certificates of "green energy", the legislation on the security market does not extend.

3. Provide since July 1, 2023 to legal entities and physical persons the right to the energy share covering of energy consumption insufficient for execution of requirements of increase in share of the energy developed with use of the renewable energy resources established by authorized bodies due to the proportional number of certificates of "green energy".

4. Exempt the income of objects of generation which arrived from implementation of certificates of "green energy", based on use of renewable energy resources from the income tax.

Take into consideration that in case of determination of tax base of the income tax expenses on acquisition of certificates of "green energy" belong to deductible expenses.

To the Ministry of Economics and finance to make in the Cabinet of Ministers offers on the changes and amendments in the Tax code following from this Item in a month.

5. And finance to provide to the Ministry of Economics:

negotiation about the introduction in the Coalition of Ministers of Finance on fight against climate changes and introduction in accordance with the established procedure offers on creation of the agreement on acceptance in the list of members of the coalition;

in two-month time - reaching an agreement with the International organization on certifications of renewable energy resources (I-REC) and passing of accreditation in this organization as responsible body (issuer) regulating this system for the purpose of assistance to implementation of system of the certificates of "green energy" recognized at the international level;

till June 15, 2023 together with Uzbekgidroenergo joint-stock company and the Tax Committee - start of the Single electronic platform of certificates of "green energy" with attraction of assistance of I-REC;

together with the Uzbek Republican commodity and raw exchange - creation of separate "section of the green power" intended for implementation of certificates of "green energy" at the exchange biddings.

To finance the expenses connected with start of the Single electronic platform of certificates of "green energy" by Special fund of financial support, social protection, development of tax authorities and contingencies of the Tax Committee.

6. To the Ministry of Economics and finance in a month with attraction of technical support of the international donor organizations to create Project office "Center of projects of green economy" in the form of public institution in system of the ministry for the purpose of promotion of "green" economy, implementation of the principles of "green" growth, projects implementation of emission reduction of greenhouse gases in economy industries.

Determine that the expenses connected with creation, the organization and implementation of activities of Project office are financed at the expense of off-budget the founder and other means.

7. To the Cabinet of Ministers to approve the Regulations on procedure for issue and issuance of certificates of "green energy" providing in a month:

order of registration of electric power producers from renewable energy resources (objects of generation) and their buyers (participants);

procedure for release and implementation of certificates of "green energy";

procedure for use and repayment of certificates of "green energy".

8. Assign to the Minister of Economy and Finance Sh. D. Kudbiyev and the Minister of Energy Zh. T. Mirzamakhmudov the personal responsibility for the effective organization of execution of this resolution.
