About approval of the Regulations on encouragement and disciplinary responsibility of prosecution agencies workers

Approve the enclosed Regulations on encouragement and disciplinary responsibility of the prosecutors, investigators and other prosecution agencies workers having class ranks.

Regulations on encouragement and disciplinary responsibility of prosecution agencies workers of the Republic of Tajikistan

I. General provisions

1. Regulations on encouragement and disciplinary responsibility of prosecution agencies workers of the Republic of Tajikistan (further - the Provision) it is developed according to article 55 of the Constitutional law of the Republic of Tajikistan "About bodies of prosecutor's office of the Republic of Tajikistan" and establishes procedure for encouragement of prosecutors and investigators, other prosecution agencies workers having class ranks for differences on service and also attraction to disciplinary responsibility for violations of service duties, labor discipline and the discrediting acts.

Military prosecutors and investigators are encouraged and bear disciplinary responsibility according to requirements of the Disciplinary charter of Armed Forces of the Republic of Tajikistan and this provision.

II. Encouragement and awards

3. Prosecutors, the having class ranks, are encouraged and awarded for approximate execution of the office debt, initiative and efficiency, and other differences on service promoting strengthening of public prosecutor's supervision, disclosure and the prevention of crimes, legality strengthening.

4. Measures of encouragement and rewarding are:

- gratitude;

- cash bonus;

- gift;

- valuable present;

- increase in the class rank;

- rewarding with the Certificate of honor of the Attorney-General of the Republic of Tajikistan

- placement on "Honour roll";

- rewarding with the breastplate "The honourable prosecutor of Tajikistan".

5. Application of measures of encouragement is performed also the following procedure:

- gratitude appears the Attorney-General of the Republic of Tajikistan, the Main military prosecutor of the Republic of Tajikistan, prosecutors of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the transport prosecutor Tajikistan;

- encouragement with cash bonus, rewarding with gift is made by the Attorney-General of the Republic of Tajikistan, prosecutors of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the transport prosecutor of Tajikistan in compliance with the procedure established by the Government of the Republic of Tajikistan;

- rewarding with the Certificate of honor and breastplate "The honourable prosecutor of Tajikistan" is made by the order of the Attorney-General of the Republic of Tajikistan;

- representation to rewarding with awards and medals of the Republic of Tajikistan is made by the Attorney-General of the Republic of Tajikistan according to the decision of board of the Prosecutor General's Office of the Republic of Tajikistan;

- representation to rewarding of prosecution agencies workers with awards, medals, letters and other state awards and to assignment of honorary titles can be brought also by other organizations according to the Law of the Republic of Tajikistan "About the state awards of the Republic of Tajikistan".

6. In case of recognition necessary applications for the caused a stir worker of the measures of encouragement which are going beyond managerial rights of the relevant prosecutor's office or educational institution of prosecutor's office of the Republic of Tajikistan it brings representation to the higher prosecutor.

7. Encouragement appears the order and is entered in the service record and the personal record of the worker. The order on encouragement is brought to the attention of all employees of this prosecutor's office or persons specified in the order.

III. Authority punishments

8. Authority punishment to the prosecutor, the investigator, and also is applied to other employees of bodies of prosecutor's office having class ranks:

- for violation of obligations on service;

- for making of the discrediting act.

9. Authority punishments for the acts listed in Item 8 of this provision are applied when are exhausted or in connection with weight of offense other measures of education, first of all, of funds of friendly impact of collective for the guilty persons, and also instructions and suggestions cannot be applied by it from the head.

Authority punishment shall correspond to degree of fault and weight of committed offense.

10. Authority punishments are:

- note;

- reprimand;

- serious reprimand;

- lowering in the class rank;

- demotion;

- removal of the photo from "Honour roll";

- deprivation of the breastplate, "The honourable prosecutor of Tajikistan";

- dismissal;
