The government of the Republic of Tajikistan and the Cabinet of Ministers of Ukraine which further are referred to as with "Parties"
understanding danger which is created for both countries by emergency situations;
recognizing that the cooperation in the field of the prevention of emergency situations and liquidation of their effects will render assistance to welfare and safety of both states;
considering advantage which can be received both Parties from exchange of scientific and technical information in above-mentioned area;
in view of possibility of emergency situations which cannot be liquidated by forces and means of one of the Parties, and also the necessity caused by it in coordination of actions of the Parties for the purpose of the prevention of emergency situations and liquidation of their effects;
supporting efforts of the UN in the field of the prevention of emergency situations and liquidation of their effects, respecting and confirming the universally recognized norms and rules which exist within the different international organizations, the corresponding international conventions and agreements, and also aiming to render assistance to development of national legal systems in this area, agreed about the following:
1. This agreement establishes the principles and framework of the mutual coordinated help which is given by the Parties in case of emergency situations and for liquidation of their effects.
2. This agreement is applied in case of emergency situations and to liquidation of their effects if the Parties cannot overcome them by own forces.
Terms which are used in this agreement have the following values:
the requesting Party - the Party which appeals to other Party about assistance;
the providing Party - the Party which grants request of other Party, about assistance;
group on assistance - the group of specialists of the providing Party intended for assistance and provided with necessary equipment;
equipment - materials, technical and vehicles, equipment of group on assistance and personal equipment of members of group;
help materials - the appliances intended for free distribution among the population which suffered owing to emergency situation;
competent authority - body which is appointed each of the Parties for management and coordination of the works connected with implementation of this agreement;
the transit State - the state through which territory, including airspace and territorial waters, groups on assistance, equipment and materials of the help and the third countries according to the agreements signed with these countries in the field of the prevention of emergency situations and liquidation their effect are transported.
1. The parties perform cooperation according to provisions of this agreement, and also with the universally international standards and the principles, for the purpose of immediate provision of the relevant information and the help in case of emergency situation or threat of its origin.
2. In case of emergency situation which arose in the territory of the state of one of the Parties this Party can request assistance to other Party. The providing Party helps the requesting Party by forces and means intended for the prevention and/or mitigation of consequences of emergency situation.
H. The parties give each other help according to the opportunities. Help is given free of charge if other is not approved by the Parties.
4. The requesting Party provides conditions of free obtaining and distribution of materials of the help only among the population which suffered owing to emergency situation.
1. Bodies which perform requests about assistance in case of emergency situations are the Parties.
2. Help is given based on request in which the requesting Party specifies:
the place, time, nature, scales and condition of emergency situation at the moment in zone of emergency situation;
information on actions for assistance, already performed or planned, priorities of the required help.
3. The providing Party immediately makes the decision on assistance and informs the requesting Party on opportunity, amounts and conditions of its provision.
4. The data specified in Item 2 of this Article constantly are updated for display of the latest events and changes in operational situation.
The parties based on request and according to this agreement, provide all necessary support during the omission through the territory of the states of groups on assistance, equipment and materials of the help if one of them is the transit State.
1. Each Party will appoint (or will create) one or several competent authorities, "Competent authorities" which further are referred to as.
Competent authorities of this agreement are:
from the Tajik Side - the Ministry for Emergency Situations and Civil Defense;
from the Ukrainian Side - the Ministry of questions of emergency situations and for protection of the population from effect of the Chernobyl catastrophic crash.
2. Without prejudice to other existing agreements reached at the bilateral or multilateral level, each Party determines or creates one or several Items of communication with the purpose of informing and assistance in case of emergency situation.
3. The parties will in writing inform each other diplomatic channels on appointment and change of Competent authority (bodies), and also Item (Items) of communication.
4. Each Party provides continuous functioning of the Competent authority (bodies) and Item (Items) of communication.
1. For implementation of provisions of this agreement Competent authorities of the Parties create the Joint working group on cooperation questions in the field of the prevention of emergency situations and liquidation of their effects. Conditions for creation and function of the Joint working group will be determined by Competent authorities.
2. The joint working group holds the meetings serially and the Republic of Tajikistan and in Ukraine, as a rule, once a year, and in case, need - by agreement of Competent authorities of the Parties.
1. Coordination, management and the common directorship of wrecking is performed of Competent authority of the requesting Party through heads of groups on the end of the help.
