Chapter 1. General provisions

Article 1. Subject of regulation of the Law

1. This Law governs the relations connected with processes of reference of information to the state secret, its enciphering, protection, protection, use, decoding or destruction for the purpose of ensuring national security of the Republic of Armenia, establishes concept of the data containing the state mystery, degree of privacy, power of state bodies and local government bodies, organizations, legal entities, physical persons in the relations connected with the data containing the state secret, obligations of persons having permission to access to the data containing the state secret, conditions and the restrictions set for their work and also the relations connected with office information of limited distribution.

2. The relations connected with the state secret in the state bodies provided by the Constitution or created by the law are regulated by this Law and legal acts following from it if the constitutional laws and the laws regulating activities of data of bodies do not provide other.

Article 2. Law coverage

1. Provisions of this Law are subject to execution in the territory of the Republic of Armenia and beyond its limits by state bodies and local government bodies, the organizations, legal entities, officials, citizens of the Republic of Armenia, foreign citizens and stateless persons which according to the status shall or assumed liability to perform requirements of the legislation of the Republic of Armenia about the state secret, and also persons, the stipulated in Article 28 these Laws.

2. Requirements of this Law are not spread on unforeseen by this Law of the information, materials with signature stamp, and also on the data containing other secret protected by the law.

Article 3. The concepts used in the Law

1. In this Law the following basic concepts are used:

1) the state secret (the data containing the state secret) – data, products or materials in the military sphere or the sphere of the external relations or economies, science and technology or prospecting, external prospecting, counterprospecting, operational intelligence activities of the Republic of Armenia which, according to this Law, are protected and protected by the state and which distribution can cause damage of homeland security or to interests of the Republic of Armenia;

2) office information of limited distribution – the data, products or materials which are concerning activities of state bodies or local government bodies, legal entities, officials of the Republic of Armenia, not relating according to this Law, to the data containing the state secret which contain elements of the state secret however in itself do not reveal the state secret and which distribution can negatively affect defense, homeland security, the external relations, political and economic interests, protection of law and order of the Republic of Armenia;

3) carriers (including electronic) the data containing the state secret (further also – data carriers) – the material objects (including physical fields) which are stored on whom data, containing state secrets (further also – the classified information), are expressed in the form of images, symbols, signals, technical solutions, process or in other forms;

4) distribution of the data containing the state secret – disclosure or leakage of the data which are under protection of the state and containing the state secret;

5) disclosure – provision of access to the data containing the state secret in any form to persons which do not have permission or competence on access to such data;

6) leakage – loss of the data which are under protection of the state and containing the state secret;

7) enciphering – application of restrictions to distribution of the data containing the state secret for the purpose of homeland security or protection of interests of the Republic of Armenia;

8) decoding – elimination of restrictions of distribution of the data containing the state secret in the procedure established by the law;

9) the privacy mode – the set of complex measures for the purpose of protection and protection of the state secret directed to the prevention of disclosure or leakage of the data containing the state secret;

10) protection of the state secret – the use of forces and means of state bodies and local government bodies of the Republic of Armenia, the organizations, legal entities in case of coordination of authorized body directed to the prevention of disclosure and leakage of data, products and the materials containing the state secret;

11) protection of the state secret – systematic application of stipulated by the legislation legal, organizing, technical, program, cryptographic and other necessary means and methods;
