About measures for implementation of the Presidential decree of the Republic of Belarus of February 13, 2023 No. 37

In pursuance of Item 6 of the Presidential decree of the Republic of Belarus of February 13, 2023 "About rent housing for the military personnel" the Council of Ministers of the Republic of Belarus DECIDES: No. 37

1. Establish:

standard form of the purchase and sale agreement of premises according to appendix 1;

standard form of the agreement on voluntary conveyance in property of premises according to appendix 2.

2. Bring in appendix to the resolution of Council of Ministers of the Republic of Belarus of September 18, 2020 No. 541 "About the documents requested when implementing ministerial procedures" the following changes:

2.1. in the column "The Documents and (or) Data Requested by Local Executive and Administrative Organs" of Item 18:

word in paragraph three of "premises of commercial use of municipal housing stock in Minsk and the Minsk district" shall be replaced with words "rent housing of municipal housing stock in Minsk and settlements of the Minsk district";

add the column with the paragraph of the following content:

"the data confirming the fact of death (death) of the serviceman, face of the private and the commanding structure, the judge and the public prosecutor's worker in connection with execution of service duties, obligations of military service, except for death (death) as a result of the illegal actions, – in case of realization according to legal acts of the right to provision of rent housing by members of the family of the died (died) serviceman, face of the private and the commanding structure, the judge and the public prosecutor's worker";

2.2. to state the column "The Documents and (or) Data Requested by Local Executive and Administrative Organs" of Item 24 in the following edition:

"the reference (certificates) of the premises and family composition occupied in this settlement

copy of personal account

the employment contract of the premises transferred to the possession

the certificate of calculations (debt) on payment for housing and communal services and payment for use of the premises transferred to the possession, or other document confirming availability (absence) of such debt

the certificate of condition on accounting of the housing conditions needing improvement issued taking into account refining of the data which are the basis for preserving the right to stay on such registry (in need of provision of data according to legal acts)

the certificate of the rights to real estate units (in need of provision of data according to legal acts) **

data on calendar length of service on military service (service) of the serviceman, face of the private and the commanding structure, the passings of such service provided by state body (organization) for the place (in need of provision of data according to legal acts)

data on the direction (not direction) on construction (reconstruction) or acquisition of premises, including by receipt of the parcel of land, provided by local executive and administrative organs, and also state body (organization) for the place of passing of military service (service), implementation of labor activity of the serviceman, face of the private and the commanding structure, members of his family (in need of provision of data according to legal acts)

the data confirming the fact of death (death) of the serviceman, face of the private and the commanding structure in connection with execution (implementation) of service duties, obligations of military service, except for death (death) as a result of the illegal actions, – in case of realization according to legal acts of the right to acquisition in property of rent housing members of the family of the died (died) serviceman, face of the private and the commanding structure

the conclusions and reports on independent assessment of market and estimated value of the premises transferred to the possession on paid basis

the documents necessary for establishment of availability (absence) of the facts, the specified in paragraphs seven and the eighth part one of subitem 1.4 of Item 1 of the Presidential decree of the Republic of Belarus of February 13, 2023 No. 37 "About rent housing for the military personnel" (if necessary)

by state bodies (organizations) in the cases established by legal acts in addition to the data and documents specified in this Item it is requested:

information from the single database provided in part one of Item 10-1 of the Presidential decree of the Republic of Belarus of January 6, 2012 No. 13 "About some questions of provision to citizens of the state support for construction (reconstruction) or acquisition of premises" provided by district, city executive and administrative organs, local administrations in the location of the specified state bodies (organizations)";

2.3. to exclude the columns "The Documents and (or) Data Requested by Local Executive and Administrative Organs" of Item 29 of the word "About Some Questions of Provision to Citizens of the State Support for Construction (Reconstruction) or Acquisition of Premises" from the paragraph of the eleventh.

3. This resolution becomes effective since May 19, 2023.
