1. Approve the enclosed Rules of accreditation of the organizations performing authentication on the basis of biometric personal data of physical persons, the basis of its suspension and the termination.

2. Declare invalid the order of the Government of the Russian Federation of October 20, 2021 No. 1799 "About accreditation of the organizations owning the information systems providing identification and (or) authentication with use of biometric personal data of physical persons, and (or) rendering services in identification and (or) authentication with use of biometric personal data of physical persons" (The Russian Federation Code, 2021, No. 43, the Art. 7290).

3. This resolution becomes effective since June 1, 2023 and is effective till June 1, 2029.

Rules of accreditation of the organizations performing authentication on the basis of biometric personal data of physical persons, the basis of its suspension and the termination

I. General provisions

1. These rules establish procedure for accreditation of the organizations performing authentication on the basis of biometric personal data of physical persons (further the organizations), the bases of its suspension and the termination.

2. Accreditation of the organizations is carried out by the Ministry of digital development, communication and mass communications of the Russian Federation (further - authorized federal body) according to these rules.

3. The concepts used in these rules mean the following:

"the accredited organization" - the organization included in the list of the accredited organizations;

"applicant" - the organization applying for receipt of accreditation;

"the list of the accredited organizations" - the list of the accredited organizations posted on the official site of authorized federal body on the Internet (further - Internet network);

"requirements for accreditation" - requirements imposed to the accredited organizations according to part 2 of article 17 of the Federal law "About Implementation of Identification and (or) Authentication of Physical Persons with Use of Biometric Personal Data, about Modification of Separate Legal Acts of the Russian Federation and Recognition Voided Separate Provisions of Legal Acts of the Russian Federation".

4. Accreditation of the organizations is effective without restriction of term.

II. Procedure for accreditation of the organizations

For the purpose of accreditation the applicant submits in authorized federal body the application for accreditation signed by the head of the applicant or the authorized representative of the applicant (further - the statement for accreditation), with application of documents, confirming fulfillment of requirements for accreditation.

The statement for accreditation is submitted the applicant in authorized federal body directly or with use of special communication of the federal executive body exercising control of activities in the field of communication according to the paragraph to third article 9 of the Federal law "About Mail Service".

The statement for accreditation is considered given from the date of its registration in electronic document management system of authorized federal body.

6. The following data are specified in the statement for accreditation:

a) full name and the address within the location of the applicant;

b) identification taxpayer number - the applicant;

c) primary state registration number of the applicant;

d) data on sole executive body (surname, name, middle name (in the presence), name of position, birth date and birth place, series and number of the main identity document, data on nationality);

e) website address of the applicant;

e) e-mail address of the applicant;

7. The following documents confirming observance by the applicant of requirements for accreditation are enclosed to the application for accreditation:

a) documents, confirmatory that the minimum size of own means (capital) constitutes at least 500 million rubles;

b) the documents confirming availability of financial provision of liability for damages, caused to the third parties owing to their trust to result of the authentication on the basis of biometric personal data performed by the organization in the amount at least 100 million rubles;

c) the documents confirming use for processing of biometric personal data and vectors of single biometric system of the databases which are exclusively in the territory of the Russian Federation;

d) the documents confirming availability of the property right or other corporeal right to the hardware cryptography (cryptographic) tools used for rendering by the applicant services in authentication on the basis of biometric personal data, having confirmation of conformity to the requirements established by federal executive body in the field of safety and availability of right to use of the program cryptography (cryptographic) tools having confirmation of conformity to the requirements established by federal executive body in the field of safety on legal causes;

e) the documents confirming availability in staff of the organization at least 2 workers who are directly performing activities for authentication on the basis of the biometric personal data having the higher education in the field of information technologies or information security;

e) the documents confirming compliance to requirements to goodwill of sole executive body, and also members of collegiate executive body and (or) physical persons - the founders (participants) of the organization having the right to dispose of more than 10 percent of shares (share), constituting the authorized capital of the organization, the established authorized federal body, containing including surname, name, middle name (in the presence), birth date and birth place, series and number of the main identity document of person performing functions of sole executive body, members of collegiate executive body of the organization and (or) physical persons - the founders (participants) of the organization having the right to dispose of more than 10 percent of shares (share), constituting the authorized capital of the organization, except as specified when the applicant is the organization of the financial market, the organization in which authorized (share) capital share of the Russian Federation, the subject of the Russian Federation, the municipality exceeds 50 percent;

g) documents, confirmatory that the applicant is the organization of the financial market, the organization in which authorized (share) capital share of the Russian Federation, the subject of the Russian Federation, the municipality exceeds 50 percent (in the presence), in the case provided by the subitem "e" of this Item;
